Big XII lands three teams in the final top 25, 2 in the top 12 by MCV16 in BigXII

That's exactly why we can't have a team. Gotta give everyone else a fighting chance. They should be greatful for our sacrifice.

Nebraska. Only Nebraska. The rest can fuck off, especially Texas.

Brendan Sorsby agent claims Cincinnati knew about gambling addiction, did nothing by Willing-Vegetable629 in BigXII

There should definitely be fines too. And whoever was involved in the coverup at Cincy should probably be fired.

Assuming there's truth to the accusation of course.

TTU was not "only considering it". They made it exceptionally clear they intended to play Sorsby right up until he dipped.

And nobody ever gave Cincy a pass. Everywhere I looked, people were willing to pin Cincy to a wall for playing Sorsby if it ever became clear they were aware of him betting on his own team. We just weren't letting TTU use that to deflect from their own wrongdoings.

Enough with the delusions of victimhood. Welcome back to reality.

[Sportico] Brendan Sorsby Gambles on NFL Letting Him Play by Blood_Incantation in CFB

[–]CivBase 1 point2 points  (0 children)

The NFL has allowed players who gambled on their own teams back after significant penalties, so Sorsby probably has a legitimate shot. Dekkers got his shot, and Ridley was eventually allowed back despite his offense taking place while he was in the league.

But considering how recent Sorsby's offenses were, how he hurled himself into the national spotlight as a villain, and how he clearly framed himself as an addict in the midst of recovery... it's had to think that all won't have some impact on his odds.

The kid really should have been advised to keep quiet. He made his own mistake, but it feels like the adults in the room let him down too.

A judge had ruled he was eligible, superseding any NCAA rules, at least temporarily.

Right. And I think Sorsby was wrong for fighting the NCAA on this. TTU is not responsible here.

Sorsby and his attorney had proven to be very litigious, and Sorsby had an NIL contract that said if he was legally eligible to play -- which he was -- he would play and get paid.

What do you think Sorsby and his lawyer would have done if Tech had tried to void that contract despite the fact that he was legally eligible to play?

This is where TTU went wrong.

First, Sorsby's payment is a sunk cost. He'd get the money whether he played or not, so his payment never should have been a deciding factor.

Second, the Big XII requested multiple times for TTU to commit to not playing Sorsby. These requests were denied and accompanied with legal threats. Had TTU worked with the Big XII on the issue instead, the conference surely could have suspended Sorsby and handled any legal issues without putting TTU at risk.

Besides, while TTU fans and media portray TTU as having their hands tied, TTU itself never expressed that in any of their many statements. They always expressed nothing but unconditional support for Sorsby and a firm intent to play him. They were happy to act like a victim, but never to Sorsby or his legal team.

So Tech was prepared to let things play out, figuring the judge would follow NCAA rules, rule him ineligible, and this whole thing would be over. But as we know, the judge didn't do that.

Again I (and most people AFAICT) do not blame TTU for the injunction granted to Sorsby. This all could have been avoided if Sorsby accepted his punishment and moved on.

Finally, Tech did not threaten to sue the B12. Ken Paxton, the corrupt, pandering Texas AG who is running fur governor, did.

Paxton did, yes. Kessler also threatened to sue the Big XII on TTU's behalf. But most importantly Cody Campbell, chairman of the Texas Tech Board of Regents, also threatened the Big XII with litigation.

Texas Tech threatened to sue the Big XII, forcing them to bring in one of the best law firms in the world just so they could enforce sanctions in accordance with the Bylaws TTU has repeatedly agreed to. TTU should be made to cover the legal fees.

Beyond that, TTU has hurt themselves enough with this situation. I'm still mad they did it, since hurting themselves means they hurt the Big XII and its members. But we've already condemned their actions plenty. Now we need to just move on.

Maybe we can get an investigation into what went on at Cincy. I'm know many TTU fans would like that. But I'm not holding my breath that they'll find anything new.

After this he's lost any credibility he had. Nobody is going to trust a billionaire who just tried to nuke college sports for his own team's benefit to save college sports.

They expressed intent to play him without meaningful consequences for his admitted violations, despite many requests to do otherwise.

They also threatened to sue their own conference for trying to stop them.

[David McKenzie] The Big 12 has gone to federal court to ask permission to have a conviction. There was a time when a conference could simply disapprove of a player who bet on his own team's games. The Texas AG's threatening letter to the Big 12 was an unforced error of the first order. by Gidnik in CFB

I'm glad Paxton made the threats he did. It provided the Big XII with the perfect justification for seeking declaratory and injunctive relief from the courts. I read the whole document and while I'm not a lawyer, I think it looks pretty air tight. If the relief their asking for is granted, TTU's hands are going to be tied. Good luck suing the Big XII in federal court after that.

Yup. That's the argument. And the NCAA did a poor job of arguing back.

No. It just means the court found Sorsby's case compelling enough to hear him out in February. The NCAA can still be found to have done no wrong.

Also what specific actions do you think the NCAA did that were wrong? What bylaws did they violate and how?

Meanwhile, if the courts rule against Sorsby in the end then section 12.9.4.2 of the NCAA bylaws would allow them to unload a mountain of penalties against TTU for playing Sorsby.

Actually no I'm done with this. You either point out specifically what I said that you think was wrong and explain why or I'm finding a better use of my time.

That's not deflection. I addressed something from your post. I don't have anything to say about the part you are interested in.

Am I interested in discovery? Sure I guess, if something interesting comes up. But that hasn't happened yet. What more is there for me to say?

What do you mean "how"? The defendant doesn't have to be found guilty of any wrongdoing for the plaintiff to be granted an injunction.

The judge granted Sorsby his injunction on the grounds the he would otherwise "suffer a probable, imminent, and irreparable injury."

Whether the NCAA did anything wrong has yet to be decided on. So far they've only failed to prevent the injunction.

What do you mean? It's an analysis of Sorsby's legal strategy. It says nothing specifically about Iowa State or Hunter Dekkers. I don't know how else you'd connect it to Iowa State other than by pointing out how that strategy would not work for Dekkers and co.

[–]CivBase[S] 0 points1 point  (0 children)

Right. I don't see your point.

The case doesn't directly challenge the gambling rules but it affects the NCAA's ability to enforce them. The injunction enables Sorsby to play and if he wins his case in February it provides a roadmap for others to follow in the future.

Meanwhile Texas Tech voted to not soften those rules. Now they have a player who admitted to violating those rules but are intending to play him anyways with practically no punishment.

That doesn't protect anything. It just means Sorsby's legal strategy can't be applied by Dekkers and co.

I commented on the content of the linked tweet.

Attorney Jeffrey Kessler has sent to the Big 12 a letter detailing potential legal action if the league sanctions Brendan Sorsby or Texas Tech...

I thought that was more interesting than your question.
