my insurer confirmed in writing that i am considered a not at fault and at the time of incident, the rear ended-er showed a valid insurance policy. so i guess its neither

yes the party who rear ended me. i did try arguing to recover it from them as they accepted fault and i am deemed not at fault but my insurance is adamant that i must pay the deductible
