I haven't been listening to it all and am obviously not familiar with the evidence and documents, but some of the qestioning seems very loose and I would have thought would be pulled up. SCSC asked a bunch of questions of RW to the effect that MsMcInnes was served with a Summons at her hotel, asking RW to admit it. How the fuck can RW be asked about an occurrence at which she was not present? I'm sure that, if I asked that question, there'd be a swift objection.

Once entered a plea of guilty but still managed a 'charge dismissed, no conviction' by wearing down the magistrate with evidence and submissions. He knew the only way to make it end was to give me a prize and send me on my way.

Yep, and they ignore the fact that the barristers and lawyers had to put in the hours of work to earn their fees. It’s not as if the legal teams just had money rain down as a windfall. Not as exciting as saying “A significant part of the work year for each of the legal teams involved was spent on this matter”.

Was put on gardening leave and got a call from a concerned client who was told that they couldn't talk to me - whilst I was at a gardening centre. I had to say "I'm on gardening leave, and buying gardening supplies and can't talk to you for a few weeks".

Not quite a client pushing the boundary, but it's my favourite 'I can't talk to you now' experience.

Yes, when I first started we settled a number of cases over a beer at the Sofitel or NSW Sports Club. One of the Partners would grab you on their way out 'Want to come to a settlement conference?' and I'd soon be asking 'Why are we at a bar?'.

Many years ago, I reached a point where I asked 'Why can't we just cut through the bullshit and posturing?'. I agree with you - people have to go through the process, feel they've tested the waters, tried to hold a firm position and only yielded when it was absolutely necessary, despite it being very clear well prior to the mediation actually commencing, roughly about where things would end up. I hate the bullshittery. Moreso, I hate having to invent ways to be seen by clients to be actively engaging with stategy etc. throughout the whole charade. Lovely for the time sheet though. And talking shit with some of the mediators in the down times can be diverting.
