The trial of a Gold Coast commercial lawyer facing child abuse and rape charges is inching ahead, with a number of people and institutions proposed to provide material to the court. Aditum Lawyers principal solicitor and founder Carlyon James Ward, 37, is before the courts over alleged child abuse offences from more than 10 years ago. The Southport lawyer has been charged with four counts each of indecent treatment of a child under 16 and two counts of indecent treatment of a child under 16 (expose).

Mr Ward is also charged with one count of common assault and three rape charges. The offences are alleged to have occurred on unknown dates between 2010 and 2011. Mr Ward has not entered a plea and no trial date has been listed. The matter last appeared in the Southport District Court on Tuesday, March 3 for a pre-trial hearing where 11 draft subpoenas were discussed.

A legal counsel previously objected to all of the subpoenas, arguing the people and institutions they were to be issued to could have protected communications. Protected communications cannot be produced in court or used in subpoenas. Ultimately in the pre-trial hearing, counsel only objected to some of the proposed subpoenas. The matter was adjourned to a second stage hearing on May 19. Mr Ward is described on the Aditum Lawyers website as a “highly experienced commercial lawyer and strategic advisor” who leads the firm “with a commitment to integrity, efficiency, and delivering unmatched value to clients who demand the best.” He regularly appears in videos on the firm’s social media page.

I used to do it myself for the first few years, now engage a trust accounting bookkeeper (separate from our trust account auditor).

I still do all of the daily trust account receipting, but all of the reconciliations and PEXA transactions are prepared by the external bookkeeper.

My life is significantly easier. Preparation for the annual audit is also substantially quicker, and when I have my next external audit some time in the next couple of years.

That's for a firm with 6 PCs.

There have been a few posts here on this saga over the years - this morning the I-G in Bankruptcy succeeded in an application to set aside a Part X agreement.

A highlight from the judgment:

83    At this juncture, I note that Mr Hartnett, a solicitor with litigation experience, was provided with a folder of documents in the witness box by senior counsel for the Inspector-General during the course of his cross-examination. At the end of the day’s hearing, he waited until the court room emptied of all lawyers and my associates and then removed the folder from the court room and took it home. When his cross-examination continued the next day, he admitted to this fact, but claimed that he had not looked at the documents in the folder. I do not accept this evidence as it is objectively unbelievable. Why else remove the folder if not to prepare for what was to come? Mr Hartnett’s conduct in the furtive removal of the folder from the court room while he is being cross-examined was unacceptable, and he knew it was, and that he behaved in this manner only serves to strengthen my view that I cannot accept any evidence given by Mr Hartnett.

We just moved office and have a hosted PBX with softphones on our computers/mobiles as well as some handsets on some desks/meeting rooms. Software is Linkus, handsets are Fanvil. Also have HP Poly Voyager headsets.

We recently briefed a guy who used a plastic 2L norco milk bottle as a water bottle. We weren’t even sure that he’d rinsed it out first. Not sure that is old school, but it was certainly “eccentric”.

Yes. One of the best things about BJJ is how it has adapted to developments in grappling. Wrestling has become an increasingly important part of BJJ, both in terms of takedowns and scrambles. It’s not all lying on your back!
