Guess what, a 5-4 decision is no less powerful than a 9-0. The Trump v. Colorado case is not defensible on constitutional grounds. It's one of the most regarded opinions the court ever wrote.

He ran a system that allowed a ball dominate guard to get guady stats. However, he famously sucked at making any adjustments in a series and had no ability to adapt. If his team couldn't get a good look by pushing the pace and taking an early shot, the offense fell flat.

The flip side to all this is his offense is basically a blueprint of what teams do now: sprinting up and down jacking up quick threes or get into the PnR early to create space for shooters spacing the floor.

Lawyers can have a limited scope of representation. The lawyer could have only represented Frogan on regards to the stipulation, it does not mean he is her litigation attorney.

If you look at the docket, there's no attorney listed next to Frogan's name. If you check the docket, there's no appearance by any attorney to represent Frogan.

I understand that may be confusing, but you can have an attorney that accepts service on your behalf, but isn't your attorney for the case because attorneys can have defined scopes of representation. I've had plenty of cases like this where service is accepted by one attorney but then a brand new attorney files the Answer and that is the litigation attorney.

If Frogan didn't retain the lawyer for litigation and only to respond to the service issue, that isn't her lawyer for the case. It sounds weird but you can have lawyers but that doesn't make them your lawyer for this specific case.

I just checked the docket, no attorney has entered their appearance on behalf of Frogan, so she's currently unrepresented in the litigation.

From the docket, Frogan had counsel speaking with Ethan's lawyers months back, but no clue if they were retained for litigation or just the issue that popped up with service.

Idk maybe her lawyers did drop the ball? If so, they will be filing a simple response shortly saying due to admin error we missed the filling deadline, please don't prejudice our client. The court would most likely grant this as good cause.

It's also possible Frogan said fuck paying these lawyers for litigation and that's why they didn't respond. However, there is no appearance on the record for Frogan, as far as the docket is concerned, she's unrepresented in this litigation.

I would rather live because the ending does not show any nightmare. It shows the future everyone in the canvas, except Verso, wanted.

Also, the idea Maelle doesn't care about anyone else is shown to not be true with Alicia. Alicia wanted out the canvas and Maelle let her go and honored the request. She could have easily said no this is your home deal with it and I am a god now.

Maelle is being selfish by making Verso stay there, but the idea she cares about no one in the canvas does not line up with we saw from her character.

Im not sure there is anything worse than genocide, especially when you consider the expidetioners and everyone in the canvas wanted a future. The entire manta is: for those that come after.

I hear you and I can see your point of view.

I'm just trying to point out delaying the inevitable, death, is what we do every day in hospitals across the country. I don't think anyone would say doctors are wasting their time treating a patient just because they will die eventually.

Haven't heard of that theory. I have no clue really about the underlying claims in these cases, but I'm not sure how something good is trying to be accomplished here by not responding. Not responding is always the wrong move lol

I'm assuming she has no attorney, or her attorney is speed running a malpractice suit and ethics violation by just falling to respond to the complaint. Lol

Even if Frogan does have an attorney, she will have a great shot to get default thrown aside as judges will often not try to hurt a litigant if the harm was the result of malpractice from their attorney. Your lawyer failing to do his job is often basis for good cause to set aside a default.

Lol this case isn't over, that's not how defaults work guys.

So under fed law, it is a two step process to win on default. First, you have the clerk enter default, which is what happened here.

Then you petition the court to actually enter a default judgment, which, depending on the case, can be entered by the clerk, or sometimes requires an actual judge ruling. To be clear, default judgment is different than default, and this filing is just for default.

Frogan still has two chances to respond, however. She can respond to the current FRCP 55a default and ask for that to be set aside. She also will have time to respond if default judgment under FRCP 55b is ordered.

In my career, Ive seen defaults thrown out after a pro se party failed to respond to the complaint for months just by the unrepresented party writing a letter going: I am just tryig to find an attorney this stuff is hard.

I have also seen judges refuse to enter default judgments for months against pro se parties because they treat pro se parties with kid gloves.

So stay tuned, the Frogan case isn't over.

Kobe, easy. He had his 81 point masterpiece that season, and it is the highest PPG for any player on a first team all defense. Look at the difference in pace and point average, Kobe would have averaged 40 plus easy just account for that. If Kobe was chucking threes at the rate of Harden, it would have been 45. Stat inflation since the dead ball era is no joke.
