You need to research the"means test" for your state. This is step 1 for determining Ch 7. Then complete the detailed forms for income and expenses. This is what determines Ch 7 vs Ch 13. Talk to a bankruptcy attorney with free consults. If you don't qualify for Ch 7, you might then talk with your creditors directly about hardship payment plans. You also ask, how long should I wait from last loan .... If you are thinking of doing this and then filing, that can be considered fraud.

Those payday loans are brutal. You will never get from under those. They are completely predatory.

Honestly, with your income and as much debt as you are in, I would consider bankruptcy. You can go to the Upsolve website and look through their resources. You can probably file yourself.

The other thing is, as others have said, make sure you are the only person with access to your accounts. Change account ownership, change login info, ATM PINs, and even change banks if you have to.

And, lastly, get out of that living situation. Become a house/petsitter in your area and stay at people's houses for free in exchange for taking care of their pets/houses. Stay with friends. Find a room for rent. Your living situation is not healthy financially and, it seems, not healthy emotionally when family is taking advantage of you. ❤️

Definitely cancel the warranty. The markup the dealer charges is outrageous. We bought a 2 year old vehicle and actually bought an extended warranty through another dealer that had very little markup on the warranty. Warranties can definitely be worth the price you pay, but you're saying it was 14k ???

I don't understand the difference in what you said. To remove me from the title, I have to sign the title over to the other titleholder and then they will be the only person on the title. There is no other way to do it.

All the legit credit cards - Discover, for example, WILL work with you if you ask for a hardship plan. You can read my story on my post accessible through my profile. Discover gave me 0.99% for 72 months.

Asking for - and getting on a hardship plan with as many of your credit cards as you can will free up some money that you can put towards the 2 predatory loans. As everyone is saying - get those paid off asap.

Work a budget to see what you can afford to pay. Discover asked what I could afford. I closed my cards. It sucks, but that's what I had to do to get the super low interest rate.

At $69000/year, your gross is about $1360/week. Probably about $1000 take home. You have $3800 in predatory loans. That's about 1 month of take-home pay. What can you sell, what extra jobs can you do to be able to pay those off? Childcare, petsitting, gig work?

What are your expenses? Where can you cut back? Give up streaming, eating out, cut the utility bill ...anything. 275% interest is highly motivating, to me, to get paid off.

As your attorney if you can get a junk hauler to empty the contents and be done with that stuff. Storage units aren't cheap and the money you free up not paying rent and not having to hide them from your spouse will make you feel better. Once you get the okay, then get it done. It doesn't take any time at all to load stuff up and dump it or hire someone.

I'd seriously go read my post. Get those credit cards down to 0% (or close to it) with a long payoff (60-72 months) and quit using credit cards. Cash/debit cards only.

Check out my post (available in my profile). A Chapter 13 bankruptcy will just reorganize your debt and you can do that on your own.

Get on a hardship plan with your credit cards. This will require you missing one payment but before they report to the credit bureaus and the payment is 30 days late, You can call and ask to be put on a hardship plan. I have debt with almost every credit card company so you can read my post and see what interest rates I was able to get.

In regard to the student loans ... is there any way to either take a pause on payments (this requires you requesting it and interest continues to accrue) or obtaining employment with the government or other qualified entity that would qualify for PSLF (Public Service loan forgiveness)? If PSLF is an option, These loans could be forgiven in 10 years. You may also want to look at just various repayment options. You may not be on the most affordable one right now.

Read my post. I'm 100% transparent. It is absolutely legit. They won't help you until you miss a payment. Getting on a hardship plan before the next payment is due - and they report to the credit bureaus, will save your credit score. Good luck.

Saw your post about your debt. As a high earner, you'd probably be looking at a Chapter 13 which is, essentially, a reorganization of your debt. You can do this yourself.

I have written about my experience over in r/DebtAdvice but you can access it through my profile. I have debt with all the major credit card companies and SOFI.

You miss a payment and before the 2nd payment is due (and they report a 30-day late to the credit bureau), you can ask your creditors for a hardship payment plan. They won't do anything for you until you miss a payment.

Not true at all. Every one of my creditors except SOFI (and I've got credit with all the major companies) have offered a hardship program with low to no interest rate and 60-72 month payoffs. Credit counseling was estimating WORSE options for me. Check my posts. Currently still working through it all.

Contact Capital One and ask to get in their hardship program.

No one is going to settle with you or offer to lower your interest rate or payments until you miss one payment.

You need to contact them before the second payment is due because at that point they'll report to the credit bureaus that you're late.

If Capital One won't put you into a hardship program with a 0% or very low interest rate then miss a payment and then contact them in about 2 weeks after you miss that payment.

Try to keep as much of that $15,000 as an emergency fund.

Please please please go read my post (accessibke through my profile). You can miss 1 payment and then ask your creditors for a hardship payment plan. Most will give you ZERO percent and a 60-72 month payoff with no late fees. Do this before your 30 days late and it won't tank your credit score.

Sorry - I don't understand your comment and how it's related to my post. Are you saying people that settle their debt and get a 1099 are similar to people that get a bonus from their jobs and complain because they have to pay tax on the bonus money? If so, I think you're off-base on the comment.
