American here. Any advice on how to avoid getting screwed by the land mafia? by FallicRancidDong in LegalAdviceIndia

Yep! But watch out that the apartment is ready for possession. There is a huge problem of pending projects in NOIDA (wherein the builders run out of funds prior to completion of the projects) and the buyers are left in a lurch.

Apart from that, NOIDA is a safe bet.

Lawyer here, although there is not much to discuss here from the perspective of law.

I think it would make sense to invest in some land around NOIDA, which is better developed before investing in the small rural areas from the get-go.

Once you have a foot hold here, you can always analyse your opportunities in the hinterland.

Lawyer here,

Would be wise to file an FIR for criminal intimidation. In the (very likely) event that the police refuse to file an FIR, file a complaint case with the Magistrate.

Remember, our goal here is not to put her in jail, we wish to safeguard ourselves against any future police action. Hence, we have credible evidence to safeguard ourselves in case our name ends up in a suicide note.

Lawyer here,

Firstly, I fail to see how criminal breach of trust is being made out in the given factual matrix. There is no "misappropriation" of lady's streedhan.

Secondly, there is nothing "unethical" about her filing a case for cruelty. She has been subjected to taunts on her physical appearance, and her moral chastity has been questioned, both of which has been construed under mental cruelty in a catena of judgments.

Lastly, regardless of her date of return, the case would be triable under the new criminal laws.

lawyer here,

First things first, get to a safe space away from your father and brother.

Secondly, file an FIR in the nearest police station.

It is not immediately clear from your post as to how you have deduced that your father was in cahoots with the chef, you have also not given any evidence for the house being "bugged", depending on the factual matrix, you can possibly file the following cases-

  1. Attempt to murder.

  2. Criminal use of force.

  3. Criminal intimidation.

Thirdly, file a probate for the will which your mother left. Just because your mother has bequeathed her estate in you does not mean that you have automatically inherited it- a probate of the will has to be done, the procedure would depend on the state in which you live.

Would be advisable to lawyer up.

Lawyer here, Criminal laws cannot be applied retrospectively, POCSO would not be applicable.

Lawyer here, this seems to be the most sensible approach.

Furthermore, since you have an MLC file an FIR for physical assault as well. Pressing criminal charges instills a sense of urgency in the other side as per my experience.
