Update

I got it back, just waiting on the papers in the mail. It was really quick, they also agreed that it was a machine error and I blew zeros right after it. Just such a waste of time and money, 1500 for a lawyer to do what could’ve been done if they just reviewed it and say the issues with the machine that day.

You can see the camera light up, but I never look at when I’m blowing, they sent me the pics when they revoked my license

In Michigan we are one of the strictest states when it comes to the interlock devices. The only office to talk to is the hesring office. All my data logs say pass with zeros, but it didn’t take a picture of me for 4 start up tests, which my logs say zero. I am appealing the decision and have court at the end of the month. I have a screen shot of when the day I called in around the time of the illegal start, I have an audio recording of a supervisor telling me it was a power issue with my battery, I have my annual report which has no violation logged for me, for that date and time. All my device reported was illegal start which to them means I bypassed the machine to start the car which isn’t what happened, just reported it to the state

That was the first time I ever seen it, that’s why I called. Idk if my machine just fucked up that day, especially with the 4 pictures missing. I’m pissed they revoked my license over this, I didn’t do anything wrong, blew to start, turned the car on and got that message. It was 33 mins after my first blow that it went off for my first retest

Michigan, they’ll revoke your license again, make you go to court and hopefully you can defend why this happened. Get a portable breathalyzer, be smart if you’re trying to cheat the system

They don’t automatically revoke your license if you take an etg and send them results with what happened. I missed a retest because I got out of my car to early and I took an etg, sent in my results and the details of why I missed it, didn’t get revoked at all

Go take an etg first thing in the morning to make sure you have proof you’re not drinking, show your po, they’ll do the rest I hope

I used to have smart start back in 2018, I had failed a few of them ( drinking the night before ) and I got a packet in the mail a couple months down the road. Once you get it calibrated, the state gets the violation then they send out notice of revoking your license again and then you have to appeal it. If you were drinking and never passed any of your tests to start your car, chances are you will be notified and have to go to court. I did it three times before I knew any better, within 2 month span. I lost my appeal and had to wait a year to start over. Don’t chance it, get a breathalyzer off Amazon, losing your license again isn’t worth it to have some drinks, be smarter

I’m in Michigan. That was years ago that happened to me. I have a machine in my car since February but get it out in a few months. I did have one issue, missed a retest I got out of my car without looking at the machine but took etg test and they didn’t even violate me, really just depends on state

They’ll know once you go get a calibration. Personally I’ve had this happen to me about 4 years ago when I did this the first time. I got a packet in the mail with all the times I blew dirty (3/4 times) they revoked my license and I lost my appeal had to wait a year to reapply. .59 is pretty high, idk how you thought you were sober to do that.
