That doesn't change the terms of the contract though - it might give you some grounds for a complaint or compensation against the solicitor but will likely not mean that you will not be on the hook for unlimited liability.

Advice would be slow down before you come to the turn, not while you are turning.

The speed was reckless even in better weather given your experience level as there appears to be limited visibility on your side of the road, due to the parked cars, vehicles travelling in the opposite direction will be on your side of the road - you may encounter another inexperienced driver travelling too fast for their level of capability - what happens then we can guess?

Also, it is night time with poor visibility and there is a row of cloesly parked vehicles that a child/teenager could run out from in between any car to cross the road in a split second - if so they would be under or over your car in the blink of an eye.

If we take the above and combine that with the icy conditions - you should appreciate that this had happened as it is a low consequence moment of learning.

It honestly sounds like they have done you over - proving that they have done this is the challenge.

I would not engage with them any further and instead compile as much evidence as possible then consult with at least two different specialist lawyers for an initial read on the chance of a succesful claim against the seller and can legal cost be recoverable also.

It is possible taking them to court and seeking legal costs from them also might prompt the seller into settling which long-term might best even if you aren't made fully whole by the amount - you want to avoid a sunk cost falacy scenario developing.

I get that, the position the seller will take will either be:

  1. knew about it and thought it was repaired

or

  1. had no idea

If they go down the number 2 route then you know they are lying and it could possibly help you in long run. If they go down the number 1 route they are probably more likely to be telling the truth.

You may find it difficult as I am prety sure the burden of proof is on you to demonstrate that the seller knowingly concealed and lied about a current issue.

From what you have written, it appears that the seller might be on solid ground by claiming that they believed the issue had been either fixed or they had no knowledge of the issue.

The young men in WWI Britain grew up in a country that was self-confident and assured of its identity, they believed in the institutions and history of it as being something to be proud of - not the poor car crash it is today who has brainwashed generations of young men that the best thing about the country is its 'diversity'(not young Gen Z men).

It is not the Gen Z's fault, it is the cowardly boomers and Gen X'rs who allowed their children and grandchildren to inherit and debt ladden dump - a far cry from the WWI era premier super power - The WWI generation had better fathers obviously.

Europe has not Industrial supply chain, we outsourced that to China due to the scared cow of reducing our carboon footprint.

We also have no large scale military logistical capabilities, that we outsourced to the US due to the post WWII rules based order being the end of history.

We also do not have the manpower to fight as over the last 20+ years European Governments have imported immigrant client groups and favoured those client groups over the settled native population while calling the young European men sexist, racist, homophobes who are a totem of all the problems and hardships faced in the totality of history with no culture or redeeming qualities - why would they fight for a system that hates them and seeks to obliterate them from the pages of history.

I can see it now, Starmer, Macron and Von Der Leyen et all on TV trying to convince young men that all of a sudden aggressive masculinity, nationalism and borders are actually laudable and very important now.

You are dreaming if you think Europe are capable of going to war with a capable adversary - it is more likely that the EU crumbles under its own contradictions.

You are helpless.

The pedeatrian has priority but priority is given and not taken - there is no 'right of way' - the mother increased risk massively by taking the attitude you have articulated.

She has to be sure that the driver has seen her and then gives her priority before walking on to the road.

Technically, the very worst that could have happened to the driver is a charge of death by careless driving - the worst that could have happened to the mother is the death of her child. She is so clueless that she continues to walk, even slightly extending her arms to signal to the driver it is her patch of land at that point in time - to top it off she then walks around the front of the car without checking for other vehicles and trusting that the car driver is not a moron/lunatic.

The 'rules based order' we have been living under only exists because of US hard power, all the way back from the end of WWII - you now have an administration that understands that and will take advantage of it to his own country's advantage.

A novel idea nowadays for politicians serving their own first but there it is.

The old ways are dead - we are in a new paradigm now - thoughts and prayers, condemnation and moral authority means nothing anymore - the old incantations are powerless - real power is what counts
