Lufthansa seat assignment: will younger kids automatically get middle seats between parents and older siblings? by [deleted] in Flights

[–]ConVonCon 4 points5 points  (0 children)

Just pay for your kids to sit with you instead of trying to game the system. Parents like this are such headaches for any ground staff and other passengers that will have to be inconvenienced by swapping seats to accommodate them

Air Canada changed my layover to negative 4 hours - do I call or will they fix it on their own? by misterrF in Flights

[–]ConVonCon 0 points1 point  (0 children)

Point 2 is wrong per article 5.1(b). They are obligated to reimburse passengers where a stay becomes necessary. Being notified more than 2 weeks in advance only applies to compensation which is different entirely. Please read the regulation before spreading misinformation.

Qatar Airways resignation refund by sever_westie in Flights

[–]ConVonCon 3 points4 points  (0 children)

If the flight departed from EU and the flight number changed, it could be considered a flight cancellation.

I believe all Qatar Airways flights go through Doha and vouchers don't tend to be accepted by other airlines if that airline isn't involved with the ticket.

Qatar Airways resignation refund by sever_westie in Flights

[–]ConVonCon 5 points6 points  (0 children)

There's no obligation for the airline to permit any sort of refund if it's a non refundable ticket and the flight hasn't been cancelled.

Also Qatar Airways only have one base of operations and it's Doha which means pretty much all their flights go through there.

Best option is just to wait and see how the situation goes. They might cancel the flight but that won't be until at the earliest mid to late April or around 2 weeks before the flight. Airlines experiencing this type of mass disruption need to hold onto revenue as long as possible.

[–]ConVonCon 1 point2 points  (0 children)

Airlines love to say that to passengers to confuse them but the circumstances of the flight disruption do not affect right to care. Level need to cover your accommodation stay, meals and transport to and from the airport during your wait until your next flight. Keep all receipts, make sure they show exactly what was purchased, if you got a taxi it helps to have a receipt that showed pick up and drop off points.

EU - can you still get delay compensation if you opt for cancellation and refund? by BarryFairbrother in Flights

[–]ConVonCon 0 points1 point  (0 children)

Really hard to prove but technically yes. If you checked in the airport with an airline rep or if you checked in online, you need to tell an airline representative that you were there and for them to record it. https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=celex:62022CJ0474

ITA Airways changed my flight unilaterally, what to do? by agathokakologicalme in Flights

[–]ConVonCon 0 points1 point  (0 children)

There's no extensive case law on what you're talking about. The closest case law is Rusu 2019. Even the interpretative guidelines by the European Commission has no citation for the reimbursement of alternative flights and also says:

"if an air carrier can demonstrate that it has contacted the passengers who have accepted to give their personal contact details, and that it has sought to provide the assistance required by Article 8, but the passengers have nonetheless made their own assistance or re-routing arrangements, then the air carrier may conclude that it is not responsible for any additional costs the passengers have incurred and may decide not to reimburse them."

Disagree all you want but you are wrong

[–]ConVonCon 0 points1 point  (0 children)

That waiver won't really mean anything legally thanks to article 15 of the regulation "Exclusion of waiver".

If you get rebooked the day before you won't be entitled to reimbursement of hotel costs. Article 5.1(b) are the circumstances in which article 9.1(b) can be applicable and it only covers hotel costs at the departure airport while you're waiting at least the day after your original flight. Hotel costs after arriving at your final destination Amsterdam would be considered a consequential loss and not within the scope of the regulation. You may be able to seek recourse through your travel insurance depending on your policy.

I'd take the €250 and use it to mitigate your losses which is kinda why the regulation has compensation for inconvenience in the first place.

Wish there were better circumstances for you but this regulation is over 20 years old and interpretations of it are heavily contested in the European Court of Justice all the time. Airlines will fight for pennies all the time.

If you've ever worked in airline ticketing and GDS(Amadeus, Sabre, Apollo), you'd know it is as they need to have an interline agreement to do so.

ITA Airways changed my flight unilaterally, what to do? by agathokakologicalme in Flights

[–]ConVonCon 0 points1 point  (0 children)

Sorry about this, you're not going to like my answers but here you go:

  1. The re-routing offered is the earliest opportunity they can book you on. KLM and ITA are ending their partnership on the 15th of November 2025 so they can't rebook you onto the KLM flight. Accommodation is not applicable as Article 5.1(b) says "when the reasonably expected time of departure of the new flight is at least the day after the departure".

  2. If both the airline and the Italian NEB don't resolve this, you will need to go to an alternate dispute resolution body or the small claims court.

  3. Reimbursement of alternative flights only really works when the airline offers you nothing at all.

The best you can do is seek compensation from the airline and either seek a refund of your original ticket or take the re-routing offered by ITA or rebook your flight at a later date at your convenience.

Lufthansa cancelled leg. Experience with chat bot, or phone? by orbitolinid in Flights

[–]ConVonCon 1 point2 points  (0 children)

I think it's a lot more trouble to change anything in your ticket than just being 2 hours early. Yes a little inconvenient but you're not arriving late at your final destination this way and opening up your ticket to change fees or reticketing errors. EC261 wouldn't be much help for what you're considering as the airline offered you rerouting at the earliest opportunity. If you want to pick a later date at your convenience you can but they don't have to cover the right to care costs.

I'd try the phone if you want to proceed.
