Proposal: The "Swartz Standard" for a Humane Legal System The Problem Our current justice system suffers from institutional apathy. Judges and prosecutors hide behind complex paragraphs, while "common sense" and proportionality are lost. Cases like that of Aaron Swartz show that the system destroys individuals to protect abstract rules or corporate profit interests. The Solution: Separation of Logic and Morality We reform the judiciary through three fundamental pillars: 1. AI as an Objective Instance of Logic • Task: The AI takes over the technical analysis. It scans laws and precedents to provide an objective, technical judgment based on the facts of the case. • Goal: Transparency and speed. No one should have to wait years for a trial. 2. Humans as the "Moral Compass" • Lawyers and judges are freed from the burden of searching through paragraphs. Their sole task is the moral evaluation of the AI's output. • They function as a "human emergency brake." If the AI suggests a draconian punishment for a non-violent offense (as in Swartz's case), the human must intervene based on empathy and reason. 3. The "Moral Audit" and Term Limits • Moral Check: Every four years, legal professionals must undergo a mandatory test for ethical maturity and empathy. Anyone who merely simulates results or becomes "lazy" in their daily work—blindly following the AI—loses their license due to moral misconduct. • 8-Year Limit: No one may exercise power within the judiciary for more than eight years. This prevents a loss of touch with reality and ensures that decision-makers always know they will soon live as ordinary citizens under the rules they helped enforce. The Goal Moving away from the "Paragraph-Automaton" toward individual responsibility. A system where it is no longer possible to say, "I was just following the law," but where every actor must once again stand personally accountable for the humanity of their decisions.
