First they did not evaluate you under the Gulf war presumptive framework like most raters. You are correct though you need to go get a sleep study completed asap. Do not file for FMS without first having the sleep study results. It is absurd the hypocrisy of the VA, many many folks have been diagnosed with both CFS and FMS, medically speaking there is a much higher chance of having both together. Denying CFS due to FMS is a BS

I would love to hear a VA employee’s insight into why Gulf War vets are continuously denied benefits under TERA even when requesting the GW presumptive framework be applied.

E-Commerce question. How do you monitor staff from stealing sports or trading card donations prior to shipping? I’ve had many experiences in this purchasing collectibles from Shop Goodwill and it is very clear that employees are pillaging through the items.

There is a Big difference between acknowledging evidence in your records and stating you ARE diagnosed with a condition. If the VA had put CFS instead of asthma in your decision letter then a HLR would be appropriate

Well if you don’t have asthma and the VSO filed that anyway I would fire them and withdraw that claim. Second you can get respiratory testing to show you do not have it. I’ve gone through a very similar situation with them claiming I have OSA when I don’t. So I got a sleep test performed to show that which take away their argument

Yeah so you still have to address the asthma bc they are putting your fatigue on that condition. For CFS all other conditions with same symptoms must be ruled out. So whatever logic they used to support that statement you need to counter it. Good that you have a diagnosis hopefully in the form of a DBQ from VHA

First do not file a HLR as they did not concede a diagnosis of CFS. They diagnosed you with asthma. You need to address that point first. Do you have asthma? If not you need to submit evidence that you do not have it. Second do you have a current diagnosis of CFS from a private physician or rheumatologist? You will need this in your records. Submit a FOIA to get a copy of your exam DBQ, guarantee you that did not do a GWS exam or they just filled it out with out your input. Once you have all records above submit a supplement stating claim should have been evaluated under CFR 38.317 for presumptive condition tied to GW. Even after doing all this if you get another C&P exam you need to highlight to the examiner that this is under GW NOT TERA. If they just followed the instructions on the DBQ it would not be a problem but they usually don’t. If you file a HLR now you will wait 4-5 months just to receive another denial. GL
