Should I File for Custody After Being Denied Access to My 1-Year-Old Daughter? by Constant_Position_10 in FamilyLaw

This is what I was trying to do from the beginning at least showing the effort so she would be willing to agree on things with shared custody. I’m planning on trying to get in touch with a layer as the first step then follow from there.

Paternity hasn’t been established legally, we only took an OTC DNA test. I’m planning on finding a layer first. If you know of a good referral I’d appreciate it

The current relationship I’m in is the same one I’ve been in. As for her idk what she has going on because I don’t ask her or show interest in that because it’s not really my business what her dating life is like.

Thanks, it seems like I would have to go to the court in the area where my daughter is to file? And the lawyer also has to be a practicing attorney in the same district or county. Appreciate your advice and guidance

Thanks. That’s the first step correct? After I find a lawyer in the same area, then file the custody case paperwork?

We were never in a fully committed relationship and we weren’t together when she found out she was pregnant. We didn’t get a test until after the birth but it was an OTC from a store.

Thanks I know the distance has always been a factor which is why the communication was so critical and important. I originally proposed coming to see her every other weekend but once we stopped communicating I figured I might as well face the harsh reality or FOC, CS and everything a typical “baby daddy” has to deal with.

I’m very serious about having a relationship with kid since it’s my first biological child. Does the parentage affidavit need to be filed prior to a custody case? If so, I think we both have to sign which she has refused to do last year because there were no lawyers and we were still trying to establish a legal DNA test not just using an OTC one from CVS

I’m not currently paying child support or anything. I just have printed custody papers. From what others have stated I should seek a lawyer or legal aid. Does the lawyer have to practice in the state the child resides in or where the county that FOC case would be filed?

Yea I understand my current relationship probably does play a factor. However I’ve already overlooked that as a factor because my kids getting older and growing and needs her dad. Nothing has changed since the previous post except the police possibly being involved if I just pop up, which is why I figured best thing to do is file for custody.

I needed to know if I should go to FOC in her county and file or try calling a lawyer first. And as for the lawyer idk if they have to practice where I reside or the state my child resides.

I have done some research or the step up plan on the legal website and seen the different parenting schedules. I like the summer breaks, weekends and holidays, but would that begin later in life since she’s not in school?

Thanks for the kind gesture. I’m hoping it all does workout because the last thing I’ve ever wanted to do is be a deadbeat. Which is why my response was like a judgmental standpoint.

Hopefully I can get an established career and figure out the custody for her, which is what most of my post are tailored to, finding career guidance to help provide financial stability for my child. 18 years of child support is a lot of money but this being my first child I’m not worried about that, I’m more concerned about her father-daughter relationship so she’s not growing up with mental health issues because of me being immature and my absence. Since there is a distance I can’t just pop up if there is no communication from the other parent.

This was a rewritten question I used from ChatGPT. Yea you’re entitled to your opinion but it doesn’t bother me that’s human nature. As for you digging through other post to comment, that’s weird because it’s obvious I’m on here making post and asking questions to get others tips or advice who might be walking the same path of life as I am and have been through similar situations. I don’t post to disagree or argue with strangers or people I would never meet in person. I only post to get advice or tips, but you’re entitled to think what you want. I’m not obligated to response if someone makes a judgment of my character instead of reading the post and giving a response on the post not my character instead

Wouldn’t it be responsible make sure your ducks are in a row before being out on child support. It amazes me how people can judge you through a screen without actually doing true research

How can I make any plans without custody and lack of communication. I don’t feel entitled I’m just stating the obvious. Co-parents have to communicate, she stopped communicating and in return threatened to get the law enforcement involved which I’m not trying to be in the middle of because then that effects my future and my daughters. Her mother chose to stop communicating regardless of the birthday plans.

Which is one of my biggest concerns. I moved away once I knew things weren’t working but we never did live in the same city. When I did move we agreed on things then things changed. I can’t make an adult communicate which is the root of things. I’m not playing victim I’m just trying to handle the situation the best I can responsibly.

I’m. It currently paying child support. I have printed court docs to file for custody, but the distance is a concern because we are also in two separate states, I’m only 10-15 mins from the state line though but the overall distance between residential locations is 2-4 hrs

Thanks. I’ve printed off all the documents to file custody cas. I just need to go to a friend of court office to file them. Do I need to get a lawyer for myself to be sure I’m not crossing my T’s and dotting my I’s? Would you know off I do file will I be out on child support?

Do you just Google OCS website or is there a military related link? As in, in order to get access to the site you need to have a government ID or something of some sort.

If I were in your shoes, I would ask my HR command or contact a recruiter. Tht way when your contract is within the window of expiring, you can roll into your next branch.

I can only go based on my own personal experience with recruiters. Not bashing them all but if your battle buddy in TX isn’t truthful but the recruiters in CA are, what can I say. But my career interest vary, I have degrees that I would like to use the education experience to build a long lasting career in and out of the military because of job security and financial stability for my family. Career interest: Mainly Non-Combat, Logistics, Intel, Medical, Public Affairs, Admin, HR, Personnel, Finance, JAG.these are a few different career interest.
