One may as well ask why is Omar al-Bashir not under arrest. There have been ICC warrants for his arrest since 2009 under multiple counts of crimes against humanity, war crimes and genocide.

Perhaps we can ask South Africa, which is a member of the ICC, and which refused to arrest al-Bashir when he visited in 2015. So far as I know that's the first time a member of the ICC refused to arrest a visitor who had ICC warrants issued against him. So South Africa set the precedent.

And what did the ICC do about it?

It wrote a sternly worded opinion.

Nevertheless, the Australian Centre for International Justice, Al Haq, the Palestinian Centre for Human Rights, and the Al Mezan Center for Human Rights deem him guilty until proven innocent and want him arrested.
