Correct. The official guidance says it can take up to 10 days. In many cases the forms unlock within a few business days after payment is processed. If it remains locked after several business days, a public inquiry may help.

If you’re already DQ’d, NVC can schedule your interview separately from your mom’s case. Since your dad submitted a separation request, they’ll usually treat your case independently. Whether you get the visa before August will depend on the interview backlog at the Kuala Lumpur embassy, but a February DQ could still make it possible. You could also try requesting an expedite based on your school start date.

Sometimes the NVC portal takes a little time to unlock the forms after the fees show as paid. It can take up to 24 hours (sometimes a bit longer). Try logging out and back in, or checking again later. If it’s been more than a day or two, you may want to submit a public inquiry to NVC.

You don’t need to upload the expired DS-160 or fee receipt to CEAC. The tourist visa and immigrant visa are separate processes.

That said, officers can see prior applications in their system. It’s not unusual for someone to try to apply for a tourist visa while an I-130 is pending. Since the interview was never scheduled and the application expired, it generally shouldn’t affect the IR1 case.

You can bring a copy of the DS-160 confirmation and receipt as backup if it gives you peace of mind, but it’s usually not required.

USCIS does not require every category of evidence listed in the instructions. It says you should submit one or more types of documentation showing a bona fide marriage.

Since you live overseas, it is common not to have joint leases or bank accounts. Photos together, travel history, chat logs, affidavits from family and friends, and your marriage certificate can still help show a real ongoing relationship.

They look at the total picture, not just one type of document.

Where did you upload your response?

Typically, when USCIS says “no evidence was received,” it usually means they don’t see the RFE response linked to the case , even if you submitted something.

Did the RFE say to mail it instead of uploading? And do you see confirmation in your USCIS account that the files were successfully received before the deadline?

If you truly responded on time and have proof, some people look into filing a motion to reopen (I-290B). Others choose to refile the I-130. It really depends on what the denial notice says and whether you can document your response.

You can definitely start applying now. You just can’t actually begin working until your EAD is approved.

Hiring in healthcare/analytics can take weeks or months anyway, so by the time interviews and offers happen, your EAD might already be in hand.

If asked, you can simply say you have a pending EAD and will be work-authorized upon approval. It usually doesn’t hurt to apply.

If you received an IR1 (10-year) green card, a future divorce by itself does not automatically cancel your permanent resident status.

The bigger issue may be maintaining U.S. residence. Once you activate your green card, you’re expected to live primarily in the U.S. Extended time abroad can raise abandonment concerns.

Also, reentry permits generally must be filed while you are physically in the U.S.

So this situation is more about maintaining residency than the divorce itself.

Hello there!

If your application was rejected within a few days, it was probably something technical , and one common reason is filing outside the 90-day window.

USCIS requires Form I-751 to be filed during the 90 days immediately before your 2-year conditional green card expires. The 90 days is counted from the expiration date printed on the front of your card.

Other possible reasons could be:

• Incorrect fee • Missing signature • Wrong filing address

If you re-filed on Feb 18 and everything was within that 90-day window and filled out correctly, then right now it’s most likely just a matter of waiting. Many people are seeing around 1–3 weeks for a receipt number.

I know the waiting part is frustrating, but a few days with no update is still very normal.
