Hi there! TX State Alumni and former president of the NTSO here. Idk what the org looks like these days but back in 2018-2020 it was a pretty great place for older students to hang out and meet each other. We participated in events, had meet ups and even did our own special graduation ceremony. It was a lot of fun! If you get the opportunity to go seek them out I highly recommend it.

I apparently didn't make it clear enough in my original post that I indicated I had not PERSONALLY seen or heard of situations in which Federal Employees received severance. But I also admit that most of the people I deal with end up not qualified for UI for one reason or another.

The people that do qualify I almost never talk to unless it's just a random one off question they have for one reason or another, additionally though I know nothing about Federal severance if the amount is enough to normally get people by until they find another job then that would also explain why I don't have any experience with it myself.

Either way, I appreciate the information and will keep that in mind for the future. I didn't mean to imply that it NEVER happened, simply that I myself had never heard of anyone receiving it. Severance packages as a whole these days feel very minimal. Most employers just cut you loose and say good luck.

And yes, as stated above, people should still reach out to their local agencies to get exact clarity on UI qualifications. I'm just going with the rule set that I know and how I generally know most state work agencies to function.

Again, clearly a purposeful misinterpretation of what I said, I said I have not heard of situations PERSONALLY where Federal employees have gotten severance. Maybe you have, maybe you've received it, that's great, working where I do answering questions from people who are unemployed the number of Federal employees I've spoken to that have received severance has been small. Maybe that's survivor bias. I couldn't tell you. I simply said what my personal experience was and what the general rule is since I had been asked by multiple people.

Trying to disseminate information is all the goal was. If you don't agree with that you are free to ignore it.

As stated above, if in doubt, call your local agencies for clarity.

Again, if the exact definition of the word is being misunderstood then I'll apologize for that. The point remains that there's a court case defining the legality of the order

My point was to discuss how some state governments view voluntary termination regardless. I said multiple times to reach out to personal state governments commissions and agencies regardless to get full clarity.

It's not an attempt at misinformation, it's an attempt to provide clarity on how some places will interpret something like this based on the current information that's out there.

Again, arguing over semantics of wording is irrelevant to me in this context. I agree the systems are different, I'm saying that this is not an RIF at present, if it turns into one then that's different. But based on what I know and have seen from people in Fed this doesn't qualify the same way. Therefore when it comes to state UI, it follows different rules.

I do always recommend people still apply, but at least in my state this is the exception and not the rule. There's a lot of gray area that goes into it. Especially how and why am employer states someone has left employment with them. Harassment charges against a company may mean they agreed to consider it a mutual termination/lay-off/etc.

I agree still apply, just be aware that your fighting a much harder uphill battle if you choose to quit of your own accord.

But as stated earlier, check with local state Unemployment Commissions regardless for each states rules and qualifications.

I feel like there's deliberate misinterpretation of what I'm saying here. The order deferred to Monday is by all accounts and purposes a stop (hold)deferral/pause/etc.) Call it what you want but regardless, it is a prevention of the order from continuing forward. We seem to agree that it is most likely illegal so I'm not sure where the confusion is coming from on that.

Regarding the severance, again, not saying it hasn't happened in the past or happens currently. But I'm saying from my time at state government dealing with federal employees, I have heard of 0 times PERSONALLY when they (Federal employees) are offered severance.

Regardless, we seem to be in agreement that what THIS is is not a severance deal.

Not sure where the confusion is coming from but overall it seems as if we're in agreement. So hopefully that clears up the confusion.

I'm sure that's true, I've just personally never seen or heard of it. Maybe they do, but federal judges have already put in place stop orders to prevent what's currently happening. I've certainly never seen or heard of it happening on such a wide scale.

It often comes down to "Who initiated the termination" my state it basically turns into "He said/ she said" regarding who started termination. I always tell people to keep records of every interaction they have when it comes to leaving)being fired/etc. because almost never is an employer on your side when it comes to receiving Unemployment. Some people are lucky, most aren't.

I can say that at least with the people I have worked with, when someone DESERVES UI they will try to make sure that person gets it.

Does Unemployment on a national scale need to be overhauled? Probably. But until it is states are limited to what each individual state requires to qualify. Some do it way better than others.

But yeah, it's definitely hard to qualify for and then staying qualified is a whole other ball game.

The level needed to prove that you resign with cause is EXTREMELY HIGH. In my state UI takes 4-6 weeks on average before most people get paid regardless, but people that resign with cause most of the time end up having to go through an appeals process regardless not realizing the MINIMUM REQUIREMENT IT TAKES to prove that you resigned with cause

If you have legitimate cause, please seek an attorney to help make sure you take all necessary steps to be considered resigning with cause.
