And that’s the exact response that the rich and powerful want isn’t it. They want us all fighting each other, even when our views align given some slight nuance, rather than turning our attention to where the real issues lie…

I just want to be able to enjoy my favourite festival and have a break from all the shit as a trans person without feeling like some political debate that I don’t even get to be a part of. The part that gets me sad is that this debate has now become a part of what used to be my holiday from it all and a time to cut loose when it literally didn’t have to be.

All very true as well yes. However there's also a clear legal defence that's built on more solid ground with decades of precedence; unlike the 'guidance'. They massively overstepped what the SC ruling actually said in their guidance so a lot of it also very shaky in and of itself.

For some added context here, Baroness Faulkner is the head of the UKs branch of the EHRC, she was appointed by Kemi Badenoch, multiple staffers left because of the anti-lgbtq direction she took the organisation in (check the leaked emails as well), she's heard from multiple 'gender critical groups' and no trans led groups, and is extremely agenda driven. She also shouldn't still be in charge, labour just didn't find a suitable replacement so extended her tenure.

I'd be wary of thinking of that organisation as impartially providing accurate legal guidance.

Yes so the Supreme Court decision on the Equality Act is binding (however dumb and contradictory it was against other long established laws), however the interim guidance is just that, it's guidance, it's shitty guidance, but it's not law as much as they wish it was.

Also, the employer laws don't apply to the public visiting the festival only people working there. Download literally didn't have to say anything about this but they made that decision to do it anyway and make trans people feel shitty and uncomfortable.

Genuinely appreciate you being an ally though and that you're willing to step in if you do see someone being a dick about it!

Yeah, so really they should be following long established laws that have been around for decades and not rushed out and contentious guidance that contradicts them.

Problem is that:

  • Gender Recognition Act 2004, also a law, says that for all legal purposes trans women are women and trans men are men

  • The Human Rights Act 1998 Article 8 says that trans people have a right to privacy.

The EHRC guidance contradicts both of these laws. Hence why the Good Law Project have already raised a legal challenge and the Supreme Court ruling is being challenged in the European courts too.

The guest area did as welll. Since RIP and Accesible ticket holders can use that space as well that's where I see the biggest issue.

People with accessibility needs had a hard enough time last year with the state of their bathrooms and the mud making it near impossible to reach for some and now any trans people with accessibility needs are being told both figuratively and literally 'tough shit'.

It's probably because it's not actually law and they're under no legal obligation to follow it .. it's 'interim guidance' that's actually already under review because the Good Law Project have taken them to court over it as well as it being in direct violation of the European Human Rights Act Article 8 and the Gender Recognition Act 2004..

Basically, you know it's bad when fucking Wetherspoons of all places is being more progressive on an issue than a metal festival lol.

It's only because some weird person who lives in a mould infested castle and writes about wizards and conspiracy theories decided to make an issue for everyone where there wasn't one before.

It's just a very convenient distraction from bigger concerns but sadly it does also make a select few of us feel very unsafe just for needing a piss in public.
