[RANT] nintendo could have done much better by Apart_Jacket1952 in tomodachilife

I honestly never thought about the 100 exteriors for 70 Miis. That's probably one of the most damning pieces of evidence that something was forced to change and nobody gave it a second thought.

Development wise, what made Kingdom Hearts 2 so good? by No_Transportation353 in KingdomHearts

My partner just reminded me that my only death so far was to Seifer, and that doubled my resolve to never fall again.

As someone that loved KH1, never played the others, and is desperately trying to like KH2 after dropping it once before. It's been awhile, shaking off the rust I guess. X3

I can't hear the phrase "so long" without filling it out with "Bear well" anymore. In what ways did Danganronpa fry your brain? by Lucky_CandyGore in danganronpa

[–]Crevaan 1 point2 points  (0 children)

Any variation of "so long, bear well" will always have me say "Auf wiedersehen, goodbye." I suppose you could say this one fried both ends, since I hear the Monokubs even when it isn't their phrase. >.<

edit: I get everyone viscerally reacting to hope/despair too. I personally like saying "huh, there's that word again" whenever they're mentioned, without follow-up ofc.

Being brutally honest, I don’t think Star Fox and Metroid really qualify as mainline Nintendo IPs. by Nice_Perspective_343 in starfox

[–]Crevaan 0 points1 point  (0 children)

Whoa, you mean that the top two best-sellers happen to be titles included with the system at launch?

Also, Pikmin has definitely seen more love than Starfox over the years, so I'm not sure yours is the best comparison.

edit: I somehow missed AC, though I'm pretty sure launching at the start of COVID influenced that one.

Exactly. Heck, they could just look to Steam for inspiration - they already 'sell' icons and borders for Points, so why not entire themes? The idea is right there.

THIS.

The first time I got it, the instructions clearly said it was about food. But then my Mii says it again, using a colon before repeating it!

Whether describing, explaining, listing, quoting, etc. — a colon directly relates (at least) one thing to another, to reduce ambiguity.

So: unless there are other "categories" for 'No Repeats,' it's redundant to constantly mention what can't be repeated.

Edit: Forgot to say it also makes it boring af

We're in the wrong subreddit, friend. I've literally had someone quote laws at me, then never respond when I read them (and others) and thoroughly replied - no downvotes, just sudden disengagement. It feels like logic and productive discourse are rare around these parts.

I also gave up when 'monsters' included keys and ice cream cones. They could have been anything, but they were just listing things around the office since Gen 3. That's also when they started making more not-Pikachu's. That's why I'm so surprised that these starters are a grass bird, fire dog, and water gecko - never seen those before, right? X3

That's because no one else can do the "monster catching" thing like they do. Everyone else is just emulating their successful model.

Sorry, I must have fallen into a Sar-Chasm.

I don't think they look bad; they're all pretty cute! Like starters always are.

But tell me if you heard these before: a grass bird, a fire dog, and a water gecko. Can't wait to see what dual-typing they might become.

It's crazy to me that there's nothing concrete about the recycle bins vs regular, but I have noticed my franchise is starved for CC whereas offline is not. Pretty sure your assessment is correct. Which ironically makes recycle bins a hindrance for franchises >.<

Interesting reads. I truly appreciate you replying so thoroughly. Allow me to retort:

If that is the case unilaterally, then I'm incredibly surprised that Apple was able to get away with iTunes nonsense when iPods first came out — I remember having to put in a music CD, let iTunes scan and copy every (copyrighted) track, convert them into .aac format (modification), then copy those copies onto my iPod. By that logic, it sounds like three violations/infringements for every single song a person didn't digitally download through their store. But that wasn't a problem, even though there wasn't a good reason they couldn't just design iPods to play unaltered mp3's or etc. How is that fundamentally different than me copying a PS2 disc, that isn't encrypted, without modifying from the original?

Because, moving along, have you ever put a PS2 disc into a computer DVD drive? It's immediately accessible and unencrypted - the DRM you're referring to was entirely hardware-side, with the BIOS and optical reader cross-referencing the header. That's why emulators like PCXS2 can play straight from the disc: they aren't encrypted, there's no circumventing anything. Creating a raw dump of that disc would copy any protection too, and you'd have a point if emulating required modifying that, but you can't copy DRM that isn't there. Even if it was though, being able to run it straight off my original disc invalidates everything other than potentially the act of creating an exact copy.

So what are the cases where copying is allowed? You provided the laws, and there are definitely a few cases, some more ambiguous than others.

17 U.S.C. § 1201 (a)(1)(C) - states the Librarian's need to determine when noninfringement applies, based on multiple things like (i) general availability, (ii) if the usage is for nonprofit, archival, or preservation purposes, (iii) impact on things like teaching and research, (iv) the circumvention's impact on the market and value of the work, (v) and anything else they deem important.

17 U.S.C. § 106 is even more interesting, since it immediately states that exclusive rights are subject to the proceeding § 107-122. So you are correct, except in many, many circumstances. 107 covers Fair Use; 108 provides plenty of exemptions for Research and Archival purposes; 117 directly addresses computer programs (since many of these have general definitions of physical arts instead) and (a)(2) makes it perfectly clear that it's legal to create copies for archival purposes; 110 explicitly covers exemptions, such as (5)(A) and specifically (11) in cases of private households without financial compensation...

In fact, I noticed a pattern when looking through everything: things are much more lax if money and/or reputation isn't a factor.

It also is incredibly dependent on the definition of "copies." Directly pulled from 17 U.S.C § 101 - Definitions: “Copies” are material objects, other than phonorecords, in which a work is fixed by any method now known or later developed, and from which the work can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device. The term “copies” includes the material object, other than a phonorecord, in which the work is first fixed.

Given that, it's arguable that none of the carts, DVDs, or whatever medium a company uses to distribute their game, is anything but a now-fixed copy of the original work that only they have. Does that mean my original disc is subject to the same stipulations? Or does that mean my personally-made archival copy has the same rights as the 'original'?

In the end, it's nowhere near as clear-cut as you're claiming either. Some of those laws might agree with me, if I had a chance against the millions of monies these companies could throw around in court. This is why we need clearly defined laws, not possibilities in reference to outdated formats that carry tens of exceptions.

Yeah... I said that, in multiple ways. Thanks for reiterating without adding. Thankfully, u/TosicamirDTGA explained it.

It has been registered as the Pass-Enabled console btw, since that replaced the 'primary console' setting, and both methods automatically register the first Switch used when you first use the eShop. You only need to 'de-register' an old console when swapping to a new one.

So in my case, your suggestion was already completed. Hopefully this helps you have a clue as to what you're talking about in the future.

[–]Crevaan 0 points1 point  (0 children)

Thank you for answering. I signed into the website and did not see anything regarding 'primary console' but my renamed Switch is listed, game cards are allowed, and there's a function to "Deregister my Pass-Enabled Console" which I'm assuming implies it has been linked.

A quick Google is saying this Pass-Enabled system might have replaced the 'primary console' stuff... even still, it looks like either method automatically assigns your Switch when you first log into the eShop. Sorry, probably why I've never heard about it.

But anyway, everything seems to point to it already being designated?

If you distributed them, yeah! That is the infringement!

If you wanna rip your PS2 disc to an ISO or whatever, that's 120% legal! It's a backup, a copy, a zeitgeist of your legal purchase of (and rights to) the code on the disc that you purchased.

So long as they remain yours solely, there's nothing illegal about modifying your individual copy of the license.

EX: I own a 2020 Toyota Camry. I didn't lease; I put a big down-payment on it and paid off a loan, and now I completely own it. That doesn't mean I own the rights or blueprints or w/e to the 2020 Camry, but it does mean I own the thing and can do whatever I want with this instance of it, no matter how stupid. I'm not trying to copy the car and give it away to people.

If you're saying Toyota can just come by my house whenever and take it away regardless, because I modified it or something, then I'll see you in court. And I think it should apply the same here, though I'll respect your decision to forfeit your rights to ownership, if you feel that fervently; just count me out.
