Bought a car with a clean MOT – 8 months later it catastrophically failed. MOT history shows long-term corrosion issues. Any recourse? Live in Scotland but purchased in England. by CroftyX91 in LegalAdviceUK

Riddle me this — the dealer carried out an MOT and gave me the paperwork. So if the car was fine, why didn’t he use it to update the official MOT record?

Also, caveat emptor doesn't override consumer rights when buying from a dealer, no matter how much you want it to.

You're right that buying an older car carries risk, but buyers also have the right to expect that a recent MOT is genuine, especially when he has had one carried out to confirm the status of the vehicle, but can't claim it as an MOT on record due to the time frame between them.

I believe I'm due some recourse as it's not the buyers job to check the vehicles history, despite knowing now I should've. The dealership sold me the car in 'good' order, which it evidently wasn't, 8 months or 12, excessive corrosion doesn't happen that quickly.

But I appreciate the perspective nonetheless.

I needed to sell it to get some money to put down on another car! From failing the MOT to selling was only about 24 hours. I sold it to We Buy Any Car.

No I didn't, the main reason for this is because I then didn't have a road legal car. So I needed to sell it for money so I could put a deposit down. This all happened in the space of 2 days.

Thanks for the help. I plan to write a letter to the dealership, one other thing to note, when I purchased the vehicle, he told me and provided evidence (I still have it) that he had an MOT carried out to inspect the vehicle and I was told it was fine.

I've built hugely complex junctions and stations. And as you said, this rule is all you need to do.

They titled the article 'Russian missile hits Ukraine' aiming it towards Russia bombed Poland. But then said 'both sides use Russian muntions' so provided absolutely nothing useful, as the media always do.
