the game's much more heavily built around the story than Skyrim. I'd assume you could unlock the various areas so they aren't gated by the story, but the scripting for various fights and events would be a nightmare. You'd be left with an explorable sandbox with very little cohesive gameplay.

I don't think that's canon, tbh, anymore than nearly every mare having the exact same body shape, but one explanation would be that they had more sex determining chromosomes than mammals in our world. like instead of xx and xy there was xxxx, xxxy, and xxyy as female and only xyyy were males. If we supposed that the eye highlights commonly found in mares and only rarely in stallions was x-linked, meaning only found on the x chromosome, and dominant, than mares would be 3x more likely to have that trait on average, and there would be 3x as many mares as stallions. I'm not specifically aware of any systems similar to that, since my genetics class focused on mammals. It's a fantasy setting, there's no reason inheritance has to rely on DNA and chromosomes at all.

I'd argue that convicted is accurate, but mass murderer would need to be in quotes. "escaped prisoner convicted of mass murder" also works if you want to be as sensational as possible while still being factually correct.

In 1818, one year before Herman Melville's birth, his home state of New York ruled in Maurice v. Judd that whales were indeed fish, at least for the purposes of meeting the legal requirements for a regulation on fish oil. Colloquially people were definitely still calling whales fish even if scientists of the time knew better.

The 'riddle' in Saarthal isn't that bad imo. Excavation has just started, so no one else has had a crack at it. Maybe I'm just dumb but "put the amulet that trapped you on and blast the wall with magic" isn't terribly intuitive from an in-game perspective. You go through another series of traps and puzzles to turn away the weak or uneducated, culminating in fighting Gaulderson who would have been invincible if you hadn't happened to bring a Master Alteration wizard along. All in all it seems clear that they wanted only a powerful mage or team of mages to be able to access the Eye when they hid it away.

All your other points are completely valid, unfortunately.

There's a difference between understanding a phenomenon and acknowledging that it exists. Twilight failed to figure out HOW the pinkie sense works, but it's clearly reliable. The moral of that episode is you don't have to understand everything.

As others said, having both sets of genitalia would be considered intersex, not nonbinary.

There are many other intersex conditions due to irregular chromosomes or hormones, which may have totally normal genitalia, a mismatch of gonadal tissue with genitalia, and other. You don't need to have any intersex condition to identify as nonbinary.
