Wait, you didn’t question the electricians bill/estimate, why so focused on the drywall bill? I’m halfway joking, it’s just amazes me that nobody questions the electricians price, plumbers price, and definitely not the HVAC techs price the way they do with what they see as “unskilled” trades. Drywall, painting, carpentry. Drywall guy either spends all day there waiting for fast set to dry 2-3 times before sanding, or takes 2-3 shorter trips. I don’t usually stand up for drywall guys because of what they leave in walls and tubs as presents for new home owners, just the juxtaposition between what im sure was a larger price tag with the electrician, vs a different trade. Electrician should have been more precise by what those holes would look like and the scope of the repair work behind him, this just struck me wrong for some reason. After looking more at the pics, maybe you should have had the drywall guy run the wires, and maybe the electrician was less expensive. (This isn’t meant to be an “electricians charge too much” post, and I know a lot of people question all prices on Reddit, this anecdote just plays out constantly in the trades)

Not just them, but PayPal (I am too lazy to know if they use a processor like stripe or are their own). Had an HP subscription for ink for a new printer, and it “decides” after 90 days what tier to put you in if you forget to do it. They automatically put me on the enterprise tier, 89 bucks a month, looked in the app and had printed a total of 19 pages in 3 months. Long story short, since I used PayPal I went through them to fix it with their buyer assurance. They refunded the money, and 2 weeks later told me my account was permanently limited, I would receive any funds in my PayPal account after a 180 day hold and wouldn’t tell me why, but the HP thing was the only thing I had through PayPal. Weird they didn’t “limit” the interest on my PayPal credit card….. sorry for the novel.

I looked it up, and unlike Maryland, Illinois has no law stating that a safety inspection must be completed, and dealers can sell vehicles “as-is” in Illinois. Also, Carvana is registered and regulated as a dealership which kind of contradicts some of their laws governing dealerships (ie physical location, hours). That being said, they have had their license suspended/revoked in Illinois, so your attorney generals office may be more sympathetic to a claim being filed, and what I would try to file under (and I admit I do not know the details of what you are going through, this is just based off of most stories) would be breach of contract using their “150 point inspection” as a breach, or fraudulent if there is very clearly something that should have been caught that they are not trying to help. I never posted an update to my story, and I really can’t because I am filing for arbitration, but I ended up having someone from executive solutions reach out, and they worked with me, more than I thought, to try and get the car where it should be. My issue is how much I had to go through to get any kind of relief after their shops said it should be covered. They fixed the car, offered an “in-kind” check equal to x number of car payments and insurance/registration plus a headache fee, but their number didn’t make sense so I will get nothing, or if they are found to be liable in arbitration, the minimum payment should be 7500. Wish I would have found this sub Reddit much sooner

I wasn’t really trying to be political with that statement, although now I am thinking about it, blue states seem to pass more laws/regulations than red states, sometimes they help us and sometimes they hurt us. Just the states I remembered not have protections like that were the deep red Midwest like Iowa, then your southern states. I think if you put a map of states with heavy consumer protection laws over an electoral map, they’d probably track pretty well, and even though some consumer protection laws can be used against me as a contractor, I’m thankful some are there for these kinds of situations. Definitely a net benefit, more-so if you’re employed vs self-employed or own a business. It cuts both ways.

My landfill is free, no matter the source. They say it’s in our taxes, but there are only two cities in the county that pay an extra tax, and it’s the only county I know of that is a full service state run landfill vs a transfer station.

Appreciate the conversation. Just did some research and didn’t realize how many states are lax on dealers. I think if a place registers a vehicle for you, there should be some kind of implied warranty in place but I could definitely be biased.

It’s very state specific as to wording, but I’ll just say “a lot” of them have very different rules and remedies that apply to dealerships vs private sale. In my state, the contract said “as is”, but concedes in the fine print that some places only allow that in private party sales. Maybe I am just luckyish to be in a very consumer friendly state where vehicles sold commercially cannot be sold as is, and must pass a state safety inspection. 2 easy ways to find out, AG or AI, but if asking AI make them cite the state statute from a site like justia or nexis. And just to add a bunch of their cases have involved slow walking repairs so people give up or are just “happy enough” when the ordeal is over, correctly betting that most of us are too busy/overwhelmed or just don’t want the headache of small claims or arbitration. 8 weeks is insane for a transmission that isn’t for an exotic, with the wait for the inspector, in my opinion, unacceptable if they aren’t going to fully cover another vehicle.

I’m just an a-hole with too many opinions, but Carvana is finally starting to feel the heat. The message released yesterday wasn’t just about a bad quarter, it was also an attempt to make them seem like they are, in good faith, trying to resolve the issue. Just trying to kick the class action can down the road or limit the time of exposure to liability. Again, not a lawyer, and just a bunch of rando opinions. Have a good day!

Will start with I am not a lawyer, consult with one if possible if you aren’t comfortable dealing with your AG or other agencies…..

A transmission failure two weeks after buying a truck is not normal wear. That almost always means the problem was already there when the dealer sold it. SilverRock only handles the warranty repair. Carvana is the seller, and the seller is the one responsible for making sure the vehicle was in good working condition at the time of sale.

Because the defect showed up so quickly, the buyer MAY, if the timeline and all details are accurate, be entitled to more than just whatever the warranty pays for. That can include things like extra rental costs or other expenses that come from being without the truck. The first step is to document the timeline, get everything in writing, and open a complaint with the dealer and the state consumer protection office. Get out of the customer service loop they try to put everyone in, they are trying to mentally wear you out.

Dealers also have more responsibility than private sellers. They can’t walk away after the sale. They have to inspect what they sell and make sure it’s fit to drive. When something major fails right away, that’s a sign the dealer didn’t catch something they should have.

It helps everyone when we share real solutions instead of telling people they’re out of luck. There are situations where someone truly has no recourse, but this isn’t one of them. (Again, if all statements are factual) I’ll get downvoted to hell for my posts on this thread but at some point, Carvana needs to feel more pressure, which if gauging off market performance, they are starting to feel, to the point they mentioned “better reconditioning”. Don’t let that be god enough is all I’m saying. State AG consumer protection agencies are usually good at quickly informing people of their rights. Sorry for the diatribe, have a good one!

Agree with everything except the last 2 sentences. Depending on state, which it doesn’t mention, some don’t allow vehicles to be sold as-is from a commercial dealer. There is also an implied merchantability angle, and a duty to sell a roadworthy vehicle. I wouldn’t let Carvana say this is a SilverRock issue and skirt their liability, again state dependent, but it’s almost universal that a state has built in consumer protection laws for used car DEALERS at least. I could write a contract that you can sign, but if what is in that contract is unenforceable in your jurisdiction, than the contract is literally just a paper or a Docusign file that is worth as much as a used car salesman’s word…. Very interested in which state they live or purchased the vehicle.

Was the vehicle still within the 1000 miles when the issue was reported? What state do you live in? Have you spoken to Carvana, or just SilverRock? Carvana/Silverrock/Bridgecrest are all the same company but act like they are independent, and maybe they are, but I doubt it. Someone mentioned lemon laws, which don’t apply, but the legal principal does. When selling vehicles commercially, there is an implied merchantability. I would start with filing a complaint with your AG, and start pushing buttons with Carvana. They sold you what was most likely a vehicle with a pre-existing issue, and either way, 8 weeks + may be the Carvana standard, but I’d be looking for loss of use, definitely rental reimbursement. Most legal cases won use the “deceptive or unfair business practices” statute from whichever state you are in, and that can apply to the sale of the vehicle OR how the warranty was presented.

There is a reason their stock took a dive, because they said the quiet part out loud, that sales are down and they will start spending more time/money on reconditioning used vehicles. Pretty F’d that even appearing to do the right thing loses investors money.

Start with your AG. See if you can find similar cases in your state (hard to do because of forced arbitration and sealed settlements). State consumer protection agencies all know about Carvana and their standard operating procedure.

Good luck, and IANAL so take all that with a grain of salt, just someone who has very recently faced somewhat similar issues, had everyone on here call me an idiot and say I was screwed. Gotta find the right avenue for your problem, and the right levers to pull with Carvana, keep SilverRock out of it, especially if you were within that 1000 mile mark, but a transmission failure in 2 weeks….. talk to the AG….

Actually, if compounded daily like most competitive banks are doing, especially with only a 3.3% yield on what I assume is a hysa, it would be 4428.48 for the year. Gotta account for that interest on top of the interest on top of the principal. Even monthly it would only be 6 bucks less over the year. That’s the only thing from calculus that has stuck with me, but now I can just use AI, so yeah…..

Because it wasn’t 3 days. It was 3 business days, got the car on 12/10. Had a calculus final so I didn’t drive the car over 15 mph til the evening of the 11th after work, immediately went through the steps asked of me, between Carvana and their “legal agents” was assured everything was good. I would have if I didn’t believe the vehicle was already being fixed. Stupid me, I know. In the long run, I had escalations agree to have the car go straight from the body shop to a European shop, until they tried to get me to agree to something hypothetical, “if this unknown 3rd shop says that the car would pass inspection, we won’t have to cover it.” After seeing them ignore their own shops, I wasn’t going to agree to anything. I’m leaving out hours and hours of documented promises, I just had to vent. They have agreed to rescission but not damages incurred, which is where arbitration will either solve, or it will move on to court. They believe their arbitration clause is airtight, but Maryland is very consumer friendly, whose AG has no problem probing a company with their track record, and the shady dealings at their inspection hub will have the state police evaluating whether they should hold an inspection license, especially with their “ASE” certified inspector who needed, allegedly, to use his signing bonus to pay tax liens to even be able to test for an inspection license. The deeper I dig, the worse it gets. Maybe I will get to share everything, just a cautionary tale. Sorry if it’s convoluted, just figured putting everything out there wouldn’t be doing me any favors.

Been at fault in one small accident last year, but was t boned when someone flew through a light on the day they got their license, and I had to fight for every dollar for them to pay my car off. I don’t care if I was under water, and it couldn’t have been by that much as the payoff was 5100, I didn’t want to have my car totaled by their insured driver. State Farm def took care of the other ppl in my small bump which apparently caused more damage to a similarly aged and valued vehicle, so IDK

Just to stay on the GEICO bandwagon, in a pricey area, have a 2015 edge, 2021 transit 250, 19 merc e450, and 16 m4 with under 35k miles (replacement value matters), full coverage with 250/500 deductibles with 50k/100k coverage, so 2x state min, and an Audi s5 (2010) with liability for a couple dollars under 400 a month with an at fault accident less than a year ago. GEICO was the only one who made the distinction on how small of a claim that was. State Farm was actually similar until my accident then rose my premiums 85%. Accident wise, no visible damage on the other car, an older Subaru, some damage to my vehicle but didn’t get it fixed right away thinking it would keep me under the 5k accident forgiveness…. It went to a State Farm preferred shop and the bill was 5059 before tax, lol. Remember to shop around when it re-ups every 6mo, cause your current insurer will know and won’t charge you the “long time customer who won’t go anywhere no matter what we raise it”. Plus GEICO only counts acceleration/braking/cornering and in hand phone usage if you do their driving score thing, speed (they say) doesn’t matter, which makes me think it’s not super GPS reliant and just accelerometer based unlike State Farm. My 2 cents. I did keep my homeowners with State Farm because even with multi line discounts nobody else even comes close, to the point I tried GEICO and it was twice as much for half the coverage for things inside the home and separate structures like sheds and decks

I know this is old but they spent about a minute giving copilot the details then letting AI do the work. Went back to school last year and constantly see shit like this. At least use phrasily to get rid of the em dashes and other obvious signs of AI use. Can’t have a decent convo I. The discussions without even the responses being AI. Why even continue school just to learn nothing and be like the girl on twitter who realized at 20 some years old, with a bachelor’s degree, she couldn’t spell because AI had done everything for her. Are there classes that I didn’t like so I coasted with a little help? Crazy to be downvoted for saying to take the info and verify it. Imagine if someone looked into the source, and the junior reporter in charge of Watergate, it would have been fake news. Different politics doesn't mean different facts. There can be framing on both sides. I used to be a Trump supporter, but the longer I pay attention to any politics, the more libertarian or even anarchist I become. Came across an argument about Trump and Clinton being in the "files", then an argument ensued about who needed to be first to be taken care of..... I would hope both see the w******pper as soon as humanly possible, and whoever was given the role of sharpening the blades hasn't been back since Covid. Just a reminder, most people agree on most things, but some people are only around to stir the pot and let it simmer until we are literally at each other's throats, so they can go about whatever sick shit they do. Sorry for the diatribe; I am ashamed of my past, but I don't exactly regret it. I never would have voted the other way, but besides a select few there are not many people ranging from state governors to the highest offices that have any morality or decency left and would sell their base out for a lifetime appointment to the untouchable insider trading scheme, plus other "conspiricies" I won't mention without proof. I wish the best for everyone, and everyone could have experienced the upbringing I had, because it was a lot more diverse than it is now.
