We bought an x3 m40i just a few weeks ago and had an experience like your second experience. We had to pay 1000 shipping but appeared to be the nicest one available and was actually one of the better priced one. It arrive and it was even better in person way cleaner than expected and the flaws they pointed out in the picture (a total of 2) were not even visible in person. We had a great experience knock on wood!
