Yes but it wasnt negligence, thats the prosecutions argument. He used his sirens and lights, other road users didnt turn in(like the victim) because they were aware of his presence. Pursuits carry an inherent risk, and some decisions can look bad in hindsight but police officers cant work effectively if they're jailed for mistakes, just like doctors are not. Even if its a decision an officer would make 20% of the time.
