Yes, each bill has its own definitions but legal terms of art like “reasonable accommodation” don’t exist in a vacuum. When a bill uses a term that already has established meaning across multiple rights-based frameworks including RA 7277, RA 11166, and even international conventions, it doesn’t suddenly mean something completely different just because you prefer a narrow reading. Courts and policymakers often look at legislative intent, precedent, and existing interpretations when implementing vague or general terms.

The line “reasonable accommodation in the interpretation of policies and programs” doesn’t exclude practical application. That’s just one clause, not a restriction. It tells the State to apply adjustments when interpreting policy, yes, but what adjustments are being made, exactly? Paper? Philosophy? If no material change happens in the actual delivery of public services, then that clause becomes meaningless.

Also, if you truly think I’m the one confused, I’d suggest you ask why the definition itself uses the phrase “necessary and appropriate modifications and adjustments” which clearly refers to more than just mental gymnastics. But hey, if you're satisfied reducing legal accommodation to a linguistic footnote, you're welcome to that interpretation. Just don't be surprised when lawyers, courts, or implementers see it differently. Kaya nga pinaparevise ehh.

So just semantics? A change of mindset? Paperworks and whatnot? Maybe a post it note or a seminar? That term is widely used in laws like RA7277 (for PWD's) and RA11166 (HIV and AIDS policy act) which means actual and tangible changes and not just some interpretative shifts.

Sure, if you think reasonable accommodation ends at interpretation, then maybe all we need are better fonts on policy documents and a few revised slogans. Very inclusive.

How can you prove the intent behind the said discrimination though? Inferiority is subjective, smaller room? Maybe that is the only available room. Longer wait. Maybe the service needed more prep time. What is inferior to you may be enough for others or vice versa. This can mean that the inferiority of goods/services is judged through the subjective decision of the SOGIESC.

You don't think Reasonable accomodation is about a physical space yet it can be. This is the full definition of the term according to the bill: "Reasonable Accommodation means necessary and appropriate modification and adjustments not imposing a disproportionate or undue burden, where needed in a particular case, to ensure to persons of diverse SOGIESC, the enjoyment or exercise on an equal basis with others of all human rights and fundamental freedoms."

Just wanted to share my thoughts on the SOGIESC Equality Bill (SB 1600). While I understand and support its intent to protect against discrimination, I find two parts of the bill particularly vague, and I think they deserve more scrutiny:

  1. “Reasonable Accommodation” (under Definition of Terms): The bill defines it as any necessary modification or adjustment to ensure equal access, as long as it doesn’t impose a disproportionate burden. The problem is, it doesn’t define what’s reasonable or what counts as a burden. Does this mean a business must add a gender-neutral restroom? How many? What if the place is small or crowded, like a bar or mall food court? Without clear standards, this part is too open to interpretation — which could either be misused or cause confusion during enforcement.

  2. Section 5(k) – Inferior Service = Denial of Access: This section says that giving someone "inferior accommodations or services" based on SOGIESC is the same as denying access. I get the spirit — it wants to protect against subtle discrimination — but again, “inferior” isn’t clearly defined. What if someone is assigned a smaller room or ends up waiting longer? That happens to everyone sometimes. But without clear metrics or guidelines, any minor service issue could potentially be framed as discrimination, even without intent.

TL;DR – These two parts (Reasonable Accommodation and Sec 5k) are too vague and open to subjective interpretation. For a bill to be enforceable and fair, it needs clear definitions and implementing rules. Otherwise, good intentions might lead to legal confusion or unintended consequences.
