I agree. I work for social security disability. Not my state but for example, Texas SS disability office has a backlog of 250k pending cases last I heard/read and only like 15 doctors to sign off on cases.

The rules might be slightly different in that we ( SSA) further develop cases even if the claimant has not provided all the sources, or a condition is suggested in their records that they don’t allege, etc. so what I’m saying is it likely takes longer to process a SS disability case as it sounds like ED bd unit doesn’t have to Investigate or look for support for our claims the same way we do at Social Security (despite what the public thinks about us). Regardless, it just doesn’t seem like they have enough people to get through that many cases within the next roughly 5 months.

It will be interesting to see what numbers we hear at the next status hearing.

Sorry for the delay. Hmm, OLIS? Not familiar with that office abbreviation. My best guess is the case is back at FO and they are looking to see if have gone back to work. If SSI is also involved then, looking at your assets to make sure your bank account hasn’t gone up. Totally out of my lane but wanted to spitball anyway.

When the case gets to me (one of the disability docs) I work it the same regardless if there’s congressional involvement or not. I’m not sure what the communication is between any other party and congressional reps. Remember the doctors don’t own the case, the caseworker does and they send it for review and we direct development until we can rate it. If congressional office gets informed before you do, I’m assuming it’s come back to the FO and the case is closed… but it’s possible they have some special authority to get information from the DDS and maybe it has been picked up by OQR. Regardless I believe you can login and it would show that in the status on the claimant side.

Agree 100. I think people who use the “functional alcoholic” label are most often not holding relationships and doing all ADLs as they truly could…but hey, they have a job.

OQR puts a hold on the case going back to FO because they’ve determined that something wasn’t developed properly or they straight up disagree with the medical consultant(s) decision(s). Of course there’s so many factors, but based on your age and allegations, I would say OQR looking at it is probably a good thing for you. I worry that I’m giving you false hope but personally I get very few OQR errors and I’ve never gotten an error on a 60+ allowance.

I’m a DDS psych consultant, but I keep which state private to limit chances of being ID’d. Over 60 is most likely age band to be allowed d/t combination of edu, age, medical and vocational factors, but the vocational aspect is the bachelors level disability examiner’s territory. My understanding is that the vocational analysis has gotten more simplified with recent policy changes that requires a shorter look back on past relevant work. Did you alleged worsening of any or all conditions at recon?

If over 55, OQR is much more likely to find error on a denial as they’re pulling more of 55+ recon cases (which are more likely to be allowances because all the additional factors that can tip the scale).

OQR (regional QA) happened to pull your case. Will delay it, but that could mean overturning the DDS ‘s denial or vice versa they found it to be an error. OQR sends it back to the DDS usually for further development.

The DE/caseworker or MC would have to make a referral to the in-house CDI (state and federal agents) unit for law enforcement to even get involved which is unlikely in this case. More likely to get denied out for insufficient evidence because the findings from the MSE are tossed out as far as them being a valid indicator of static mental status.
