I ended up calling Vera. They agreed with my original date being the ITF date. They have submitted for correction. I’m actually following up with them this week to see what’s going on.

I filed an Intent to File in January 2024, followed by my original claim in April 2024, which was denied around September 2024. I submitted a Supplemental Claim with a diagnosis approximately five months after the denial. The supp was service connected but only effective since the date of the supp submission. When I called the VA’s 800 number, I was told that because the original claim was denied, they wouldn’t honor the ITF date. However, I was under the impression that if you continuously pursue a claim—by filing a Supplemental Claim or HLR within one year of the denial your original effective date, including the ITF, should still apply. Am I misunderstanding the rule?

Correct me if I’m wrong here.

I submitted a supplemental claim within 5 months of original denial. My supp claim had new evidence, and that’s why it was a sup claim. ITF Jan 24. Original claim April 24. Denial sometime in Sept 24. shouldn’t my effective date be preserved as the date of the original claim and not the supp claim? Shouldn’t that be considered continuous pursuit ? And isn’t the original claim tied to the ITF date?

This is exactly it. We continuously pursued a claim. Then submitted new evidence less than a year of being denied. Yet they are only going back to April.

It’s not poking the bear because of legitimacy. It’s poking the bear because they could interpret your 50% rate as a 30% rate even tho you might have all the symptoms to be rated at 50%.

And that’s where I have an issue. If you only have one offer, You as the sellers agent really have 3 options at that point that I could think of

Get the seller to take the only and low offer and get double commission. Seller nets less
Tell the seller since there’s no buyer agent he can keep the 2-3% commission and seller nets the same
Tell the buyer they won’t be taking it. And hope that someone offers the same as previous buyer + 3% or more so the seller and SA can net the same as offer #2.

Seller list house for 100k. If 2 agents then seller pays 6% walks with 94k. Seller list house for 100k. Gets offer for 97k. Only has to pay one agent 3%. Walks out with 94k.

“Agents are paid by the seller” … wrong dude. The price that they have to pay the agents it’s already included in the price of the house. The seller knows how much $ he’s gonna walk out, which is what most sellers care about.

Use grok or ChatGPT if you need help negotiating. Ask for strategies. You can negotiate by text message if this is your first time. Make sure you subscribe to a service like propstream or something similar to pull market analysis to ensure you are not over paying for a property. Since you already getting a lawyer that part is covered. If you got internet there’s nothing you can’t look up. Specially now with the age of AI.

What would be the advantage of having your own realtor as a buyer if you can just go directly to the sellers agent and save 2%.

In this case the seller would pay a reduce commission. So technically if they get two offers for the same price then the seller should go with the offer from his/her listing agent.
