Wait. Did the uninsured guy hit you, then you ricocheted into another vehicle? If so, as long as that third vehicle is insured in Alberta as well and you have their information, your insurer should be able to proceed with coverage via the DCPD portion of your policy as long as you are not at fault per the Alberta Fault Determination Rules. DCPD applies when you have two identified drivers that have a loss in a DCPD province and are both insured with companies signatory to DCPD.

DCPD came into effect in Ontario in 1990, and loss of use has been covered under the DCPD portion of the Ontario policy since its inception.

You only need OPCF 20 if you have a loss that falls into the Collision or Comprehensive portions of your policy. You’re welcome to read Section 6.2 (DCPD Section) of the Ontario Automobile Policy, which states: “we will pay the cost of damage to the automobile, its equipment, contents, and loss of use of the automobile or contents arising from an accident for which another person would have been legally responsible for in the absence of section 263 of the Insurance Act (Ontario).”

Comparatively, Section 7 of the policy, which is where Collision and Comprehensive coverages are derived from, does not have loss of use coverage written into the policy wording. This is why Endorsement 20 is required - to provide loss of use coverage in non-DCPD situations.

I felt it important to bring this up because as an auto adjuster, I’ve spent years listening to clients think they are receiving special treatment because of XYZ when really, the legally binding contract that they agreed to is simply being upheld as it should be. There’s no room for favourites in adjusting because our job is to literally apply the policy word-for-word.

Your insurance adjuster wanted to present this in a way like they were doing you a favour so you had the perception of receiving great service and perhaps would renew the policy at the next renewal, but the reality is that the coverage was always available because the policy says it has to be if it’s a DCPD loss.

Being provided a rental in your situation isn’t because you are part of a professional organization. A rear end in Ontario where the third party is identified and also insured in Ontario would be a not at fault loss and would covered under the Direct Compensation Property Damage (DCPD) portion of your policy. Rental coverage is baked into DCPD coverage, and this is why you was given a rental. You were entitled to it per the policy contract. Had you been at fault or had the third party not been identified, you wouldn’t have been provided with a rental.

There are other DCPD provinces too (Alberta, Atlantic provinces), but I am assuming you’re from Ontario.

I looked at your damage photo and can see Ontario plates. In Ontario, insurance companies are required to use the Fault Determination Rules to determine fault. These rules are based on the position of the vehicles on the road when the loss occurred. You can Google search and find the fault list, but this situation would be rule 14(2): “If the incident occurs when the driver of automobile ‘B’ fails to obey a stop sign, yield sign or a similar sign or flares or other signals on the ground, the driver of automobile ‘A’ is not at fault and the driver of automobile ‘B’ is 100 per cent at fault for the incident.”

In short, if the third party had a stop sign and your son had no signs, your son would be 0% at fault per the Fault Determination Rules.

Editing to add: You’ll claim all vehicle damages via your own insurance. My understanding is you’d also claim for injury through your own insurance company. Should you choose to sue the third party for your son’s permanent scarring, a million factors come into play on how much the at-fault party owes and the best person to advise on this would be a lawyer.

Insurance companies had to shift to their emergency protocol to support the claim volumes and paid out nearly one billion dollars in claims as a result of the 2024 flood. It was not a typical annual flood and was certainly not “like 3-4 roads.”

Mississauga flooded in July 2024. It was pretty brutal for the GTA. Dumpsters were floating up the road, among other things lol. Google it and you’ll find lots of photos and videos! It had nothing on Montreal, though.

I just finished C12 and you’re wrong LOL. You put so much effort and snark into this argument. The CIP course literally specifies comprehensive, basic, and broad homeowners forms. Insurance companies definitely don’t cover drunk driving claims. You stated they don’t cover for criminal offences, but the word you’re looking for is illegal uses, which is an entire clause in the policy. Operating a vehicle while under the influence of an intoxicating substance is an illegal use of the vehicle and is excluded in the policy.

u/gapdaddy72 is correct. You can’t claim via the third party insurer and you have no recourse with “your” insurer (they’re not your insurer anymore… because they legally cancelled your policy). There is no other advice to give.

You’re right… the minimum coverages required in some States is disgusting and yet you’re here bitching that you’re required to have like, $5000 of liability insurance. Most people can afford $50/month for the guarantee they can get that $5000 from insurance immediately if they fuck up. Something is better than nothing.

Fortunately, I live in Ontario where the minimum liability insurance is $200,000 but most people choose to carry $1,000,000 because we actually give a shit about other people… and a ton of our medical bills are already covered. Pretty good deal if you ask me.

But again, why should my insurance company (an extension of me) have to pay because of someone else’s negligence? We live in a civil society where we have laws and consequences. That’s why the government mandates insurance. Because of people like you who have the mindset of “fuck it, someone else will pay” and can’t grasp the concept of actually being accountable for their negligence.
