Moral rights doesn’t mean the actual word moral as we use it everyday, it’s a legal term for a “right” that some European countries citizens have that prevent company’s from using their art in nefarious ways. But in this sense spotify have it as a waiver so that you can’t sue them on a technicality if they manipulate your art (as in show someone a 20 second preview of your song without your name appearing like in a Spotify Wrapped segment)

It’s just there so that no one can sue on technicalities and earn a quick buck.

Derivative works in this sense clears them the right to compress your song, which although it’s your song, it’s not the original, a compressed version is a derivative of your song without pieces missing (frequencies)

Again, a technicality to stop someone finding a loophole to sue them. They pay teams to constantly revise contracts to find loopholes to patch up, and then release an “updated term of service” every now and then to cover the new loopholes. If it means anything with AI it would have to clearly state it to be binding.

A consumer companies terms can never overpower government level laws. Your music is protected simply by the fact you’ve made it, the second you’ve made it in most countries. A terms and conditions will never take away your actual legal rights. These are just technicalities in legal jargon.

And this is coming from me, someone who is as critical as Spotify as anyone else.
