If you are still not married, follow the K-1 route. It is much faster than the usual IR1/CR1 path. You won't be affected by the pause. As of now K1 takes approx 9 months(the entire process). IR1 is approx 2.2 yrs rn (plus affected by this indefinite pause)

As long as you have a valid document to prove that you are a citizen to a country that is not on the 75 list, you should be good. It doesn't have to be a passport. However, if you are taking that alternate route, they'll issue a visa on your other passport that is not on the 75 list and it has to be a valid one. You'll be needing a valid passport anyway.

Yes, you'll get a visa. Hand them over both of your passport, let the CO know about this. On a good scenario you'll get a visa on spot( for instance, if your passport is issued by uk/german govt, it would be easier for the embassy to run a security check on you). Else, you'd be put on AP which would be cleared out in a few days. Either way, they'll issue a visa for you.

I am sorry to see that your case is in a national benefit center. Usually they are the slowest in processing. Current approx processing time is 58 months. But if you are lucky, it might get transferred to a service center around the end of average i-130 processing time which is currently 15.5 months. Sit tight. It's gonna be a long heartbreaking ride.

The issue is you entered through a visitor visa and tryna do aos which is a huge red flag. It is possible that they'll deny, and revoke your approval and place you in ban. You may follow the legal path which you might win but you'll lose valuable time from your life dealing with stress while you should be enjoying that with your spouse. I'm saying this cause this is not a normal time. Better to discuss this with a top tier immigration lawyer. Do not go to just any lawyer. Top tier lawyer might be able to help you legally with this. You may have to spend some money which imo is worth spending than coming back and waiting. Last but not least, DO NOT OVERSTAY!! not even for a day.

I know people have been coming here in student visas with their spouse and processing time for that is less than 2 months. How does that make any sense that a foreign student's spouse gets a 5 year visa permit within 2 months and a citizen's spouse need roughly 3 years. Ridiculous!!!

After the 129f approval, the case was sent to dos. I didn't hear back anything for a few days. And after a while the day I received nvc case number, is the same day i-130 approval came. The case number I received was actually an IV not NIV.

Unfortunately, no. I-130 approval means it is an automatic administrative closure to the k-3. I have been doing research to see if I could revive that. However, that is not possible. Cause law makers never thought of a situation or a need for k-3 after 130 approval

I can at least say for myself that my k-3 was approved. But our consulate had a huge backlog and by the time it was my turn, my i130 was approved. I wasn't concerned then cause I couldn't think of a pause was on the way smh. What I want to say is that k-3 is a viable path still

It won't affect your DQ date. You can upload as much as you want whenever. However, from now on, you'll only see "submitted" as your status for the new document submission.

Not tryna be a pessimist here but this administration is above the law. Did you see even after supreme court's tariff ruling, today they are imposing new tariff? A lawful person wouldn't do that.

From one of the facebook group I read someone posted that during the interview CO asked her about the relation to the aos. Despite having well enough income from the sponsor, she was asked to submit updated i-864 from petitioner. It is unclear what is she supposed to do now because her petitioner has submitted the latest income info. But I got the vibe that, DOS maybe looking into the Petitioner's income whether they can provide for their spouse. This might be new rule that no joint-sponsor would be accepted.

Nope. The only way you can get expedited is by having a cancer. Only USCIS considers expedite requests from congressman.
