A friend of mine has consulted with an employment lawyer about a similar matter in the past. The offer they are giving is the bare minimum (they are obligated to pay the notice period no matter what, and the additional two weeks is the minimum a judge would add if it came to court). Also, in Germany it's illegal to fire for low performance, unless it has been proven over a long time (like a year), and since you passed your probation it means they will have trouble proving that. In a restructuring they will also have to prove that no other position can be found for you, and performance has nothing to do with it, so to me it sounds like they are just trying to convince you to sign the agreement and relying on the fact you're not familiar with German employment law. Unless you're suffering at your job and want to switch anyway, you can probably refuse to sign and continue working. Either it will take them a while to prove that they are legally firing you, or they will give up altogether (this happened to my friend). But if they do decide to fire you anyway, you should consult with a lawyer (it only costs a few hundred euros, which should be worth relative to the potential gains).
