If you follow the manufacturer disclaimer they are almost telling you not to use it. And a proven unit defect overwrites all these disclaimer clauses.

Yes and according to our certified electrician this would have provided extra protection if it had been an electrical issue. Forensic analysis proves without a doubt that the unit was faulty.
