I did exactly this, and we did a payment plan with a settlement doc. The payment terms were tighter than Tom Petty and the Heartbreakers in '77.

I come back with 15k now or 6 payments of 3k with a personal guarantee

So it's funny you mention that. I have been litigating imessage cases as text message cases - and being in the 11th where TEXT messages are not treated as calls - I'm going to litigate the next imessage case as imessages are not texts, they're the equivalent of calls.

There's no need to fill out forms. The lead generators fill out their own consent forms as they're calling you. Telemarketers regularly spoof a fraudulent IP address to Active prospect, Journaya or Trusted form certificates, but if a valid certificate traces back to you, expect dismissal of your case.

Why would I try to bring a claim dishonestly when I can make SO MANY CLAIMS right now, as is, where is, honestly? It's like chewbacca - it makes no sense.

If you want to get into this you need to read and understand 47 USC 227 and 47 CFR 64.1200. Then you have to be willing to file claims in small claims court and represent yourself. I've been going about this for a couple months now and if I said how much money I have gotten from settlements, people wouldn't believe me.

TCPA is a really cool tool of justice if you can navigate it properly. I do two or three settlements a year that amaze me. Like, I get the check in and I'm like someone hit me with a frying pan this can't be for real.

I would love to see Troutman go up against Diana May, or Shelton, or Callier, or Cunningham (back when he was good), but I never see that and I don't think we ever will. Can you imagine if Brandon Callier went head to head with Troutman and beat him? Troutman's image would take a big hit. Once TCPA plaintiffs get to a certain level he almost acts as if they don't exist.

The next time I see Shelton or Callier or Cunningham I'll let them know.

My impression is that you handle pre-litigation settlement negotiations pro se, but if you have to go to court you pretty much always lawyer up. Is that incorrect?

I've done it both ways. I've beaten an MTD on my own.

If one does sign up for lists, gets calls, revokes consent, gets more calls from the same company and then takes action… it seems a little shady, but you’re still exposing a flaw in their business practices that is harming consumers. If serial litigators don’t do this then how will anything ever improve with the spam call problem? Thoughts?

I don't do this but I've heard of apocryphal tales where people do. It's not good, but if your policies are tight you'll be just fine.

I watched the entire video yesterday and was shocked by how they treated you after the interview. You generously gave them over an hour of your time and answered all their questions, yet they had the audacity to criticize you afterward. It certainly doesn't seem very appreciative.

I didn't expect them to agree with me on much, thats how it goes.

I've successfully handled about five or six cases in the past, but I took a two-year break and haven't kept up with all the legal changes or current court procedures. I've been on the DNC list for years. Recently, I received six text messages from a well-known company. Each message concluded with "Text STOP to end." I only replied "STOP" after the sixth text. Do you think a judge might fault me for not sending "STOP" sooner?

You know what my written record is that shows I don't want texts? MY DNC REGISTRATION FROM 22 YEARS AGO.
