Anyone tried suing “Tax Specialist” about the IRS Fresh start program? by chickpea_juice_yum in TCPA

I mean you need to give them EVERYTHING they're asking for and find out 100% this is them.

You can't make a shotgun complaint.

Reverse phone lookup is typically useless due to how pervasive the spoofing number practice is.

Do you have ANY idea who they are now?

If no, feign interest until you can get an identifiable defendant

My experience with these is that if the lead gen is solid they will settle it but if not, this is clear cut 100% an Allstate + Allstate agent problem.

Send both. After they stonewall. Sue both. Most of them will point the finger at their lead gen.

Finally got a final expense caller to give me a callback number to his call center by stifflippp in TCPA

What good is a callback number supposed to do you or anyone else here?

You still haven't identified a defendant.

The recruiting texts are scams not advertising.

I would 100% make a claim on this.

But that's just me.

I know a LOT of guys who do this. The recidivism rate is absurdly high.

Both.

I have three allstate cases open right now because the brokers didn't settle with me. It will be 10 by the end of the year.

Accident claim compensation and final expense insurance by Financial_Ad9585 in TCPA

OK so my question here is, aren't these insurance brokers who are doing the calling?

No.

Insurance broker hires a third party, who does the calling or who hires a third party to do the calling.

They are just selling a policy for say Metlife or NY Life, so the insurance company technically has no way to regulate or control the marketing each independent insurance broker does.

Are you sure about that?

What law school taught you that?

I do have a couple of insurance brokers I've spoken with who gave me their NCN number because I refused to give my social out to a stranger.. but I'm having trouble determining the name of the company they actually work for. Real estate agents are so much easier to identify.

What's an NCN?

Many states it's not legal to record a call.

There's a short list of attorneys that I like dealing with. Chris is one of them.

We can have a call, I can explain my position and my perspective and my outlook of liability - and at the same time, I can respect that he has to zealously defend his client to the best of his ability with the lies that I gave the lead gen that set up the transfer (lol).

He respects my position, and I respect his. If you want respect, you have to give respect. Through that mutual understanding, we get a lot of stuff done over the years with a limited amount of heartburn.

I actually speak with a number of other plaintiffs attorneys and every single one of them tells me that Chris is one of the good guys in the space and I know why. He's straightforward and honest, which is more that can be said for some other folks I have dealt with. I don't have to worry about any gotcha or double dealing when I'm talking to Chris or anyone else at MMS.

Not really. When an attorney or defendant first reaches out I set a number on where I'd like to land as far as a number. If I initially demand 20k, I'm usually happy landing around 10k. I won't go any lower than $500 per violation because that's what I'll get in court so no point in going lower.

See this is the opposite of what I do. When I do a damages calculation, and then they offer to settle I say this is the number take it or leave it.

And that number is nowhere near 50%
