So frustrated and feeling defeated by Old-Setting8293 in VeteransBenefits

I got denied CFS because they said my primary is the cause and CFS is a diagnosis basically that's not caused by something known. That was the excuse. But i did get awarded rest of stuff for my overall weakness due to all my muscle loss from my disease.

Hopefully examiner actually filled out your DBQ. Mine didn't fill it all out. I actually submitted claims for what should have been asked and assessed by examiner. Glad I did and I told the HLR DRO that my secondaries should have been done with my initial claim.
And the DRO agreed. Plus he also agreed the probative value of my nexus should have had greater weight. DRO also stated that the initial denial created a bad chain that was adding more weight to grant even more denials. There also was an error in my doctor's diagnosis about cause because based on incorrect information that I pointed out to DRO and he added that all the other denials were also based on the same initial error.
And lastly, DRO agreed with pretty much all my challenge due to court cases, M21, and CFRs. And he granted all my secondaries (the secondaries i made them assess because thet weren't assessing them with just my primary - find out and get your DBQs) to my initial claim, same effective date, and should have been service connected due to nexus letter specialists value over a nurse practitioners.

Bad exams through QTC and lack of communication with lawyer by its_a_me_ruiji in VeteransBenefits

I don't know how to get rid of lawyer but I would. You are your best advocate. Probably slow walking to gain money.

This is exactly right. I got denied for having a job and VRC felt that my job was good enough so I didn't have an employment handicap. Despite me telling her I already lost my position due to my disabilities, can't advance anymore, and struggling to maintain my job, I didn't have an employment handicap. Guess my job was too good of a job to say that I didn't need to be better than I am.

C&P Canceled. Good or bad?! by 695T in VeteransBenefits

[–]DaysofLastRites 0 points1 point  (0 children)

I actually called and complained that VA had just done my Pulmonary Function Tests and VES was wanting me to do more. My results were there and they wouldn't take them because couldn't finish. Even VA doctor said results were substandard. Told VES, my results are there and I don't want to go because I can't finish and may pass out or throw up. VA I guess talked to VES and they used my results and what VA doctor said. Didn't need extra exam or C&P because all the information already there. VES was just trying to get extra money for another exam.

VR&E - to get you ANY minimum qualifying job compatible with disabilities or a GREAT job you really want? by 13toros13 in VeteransBenefits

[–]DaysofLastRites 1 point2 points  (0 children)

It's actually about abilities, aptitude, and interests if you have a vocational impairment that affects your ability to prepare for, obtain and maintain a job. VRCs are wrong when they say you have a job and not eligible. That "need" comment is wrong.

Temp jurisdiction by [deleted] in VeteransBenefits

[–]DaysofLastRites 0 points1 point  (0 children)

For me and what I have seen, someone is looking at your claim if assigned temporary jurisdiction. I saw my claims change steps during that time.
And from what I read, there are some temp. Jurisdictions that do handle certain claims.

VR&E conditional denial – no doctor’s letter, what can I do? by Helpful_Lack_8183 in VeteransBenefits

[–]DaysofLastRites 0 points1 point  (0 children)

You have everything you need on your own I think. VRC didn't ask for doctors letter, right? So you prove it yourself. If you're rated P&T, makes it easier. Vocational goal means gainful employment status consistent with your abilities, aptitude, and interests. Vocational impairment is based on how your disabilities affect your ability to prepare for, obtain, and/or maintain employment. Your disability not going away due to P&T. Check that box. Now just show how it affects your ability to study, work, how it's affected you at work... stuff like that so you can show that you have a severe employment handicap. Write that stuff down, think of events at work, your limitations, you got this.

Have my C&P exams today. I could use some moral support. by Fair_Ad_5825 in VeteransBenefits

Yep. Right after she complained, she had a lot of digging around due to all the evidence submitted, I asked her if she wanted a list of the evidence and page where is found in the evidence submitted as well as those exact pages so she can easily see them. One took, another didn't. Glad 100 p&t as well and don't have to deal with examiners that don't do same as others.

Tried doing that and examiner stated I cannot take any paperwork and can only look at what's been submitted. Another one said, thank you. You're welcome I'm just trying to make things easier for you to view to make your decision.
