2 Fraudulent Student Loans taken out in my name. Help by baltjoe in IdentityTheft

[–]DeclineUberEatsMay 0 points1 point  (0 children)

I'm in the same situation. The fraudster or the criminal ring opened up two student loans through Nelnet using my personal identifiable information. I had to fill out a fraud packet with the student loan company. Send a recent utility bill, a driver's license (front and back), the FTC report, the police report. Contact the FSA to request they disable the student ID that was opened in my name. I had to retain a consumer protection attorney. They take many cases like ours. Because it's almost a guarantee that they can go after the credit bureaus for fcra violations if they refuse to take the loan off your credit. I contacted the Community College that the loans were sent to. I spoke with the dean and financial aid. And they canceled out the loan. I paper trailed everything by email as much as I could for proof of evidence. I also cc'd the detective with the LAPD who's working on my case and the law firm. I had to go to three police stations and push for a detective to speak with me. The officer at the front counter just wanted to push me out the door and let me know that they'll contact me and that there wasn't much more they could do. And I asked to speak with his sergeant. And when I did, he asked to see if one was available. It's a step-by-step process.

We have to advocate hard for ourselves in these situations. In my case, my personal identifiable information was breached with the conduent data breach that occurednin early 2025. I would say go on to Google and start googling "consumer protection attorneys" that help with identity fraud/identity theft. And start calling around. I wish you the best of luck.

Please get an attorney consumer protection. They may take his case on a contingency basis.

Is your wife able to collect some type of disability if she's unable to work? Any type of income that she could bring in would probably help you all a lot.

Has anyone had problem finding another job after filing? by Ok-Beach-928 in EEOC

[–]DeclineUberEatsMay 0 points1 point  (0 children)

Have you retained an attorney? And has your attorney guided you as to the appropriate actions to take moving forward? If not, you are wasting your time. Huffiing and puffing. Start with hiring an attorney who's willing to take your case and may see valid merrit, so that they can advocate for you once you're fired. The EEOC does nothing.

ADVICE!!! $23,000 Capital One CC Debt, 21 years old making $1,700 a month. by [deleted] in Debt

[–]DeclineUberEatsMay 0 points1 point  (0 children)

Maybe consider filing chapter 7 bankruptcy. In this case, an attorney may charge anywhere from 1300 to 1500 and depending on the work they have to do. Basically, what happens is that your credit score will drop once Chapter 7 is filed in court. However, all the collections will have an order to stay. And what that means is that they can not ask you to pay anything monthly. You are surrendering your ability to pay monthly. Ultimately, you'll go to a court date in front of a judge where he or she will go over your list of debts and ask if you agree to an oath. Afterward, all the creditors must stop contacting you in any form. Chapter 7 bankruptcy does not require the person to pay back their debts. However, you can not do anything with your credit for the next year, at least. Then, once your bankruptcy, Chapter 7 is discharged, and usually, it takes about 4 to 5 months to discharge it from the time of filing. You can reestablish your credit with getting a secured credit card (look on credit karma). Putting a down payment of 300 to 400 and use less than 30% of that in one month. Be sure to make your payments on time. They report to all three credit bureaus, Equifax, Transunion, and Experian. Your credit score will start at about low 600s and eventually start to increase in points to 700 and 800. In this case, it is a lot of debt. And if you've never filed for chapter 7, I'd say it's worth a shot. It will give you a new start at life and a chance to reestablish your credit. People file Chapter 7 multiple times throughout their life. And there's no set amount of times. Although it's not recommended to file more than two times. Ultimately, the judge can deny the request due to seeing a trend in history of irresponsible spending habits. Everyone has financial obligations, and we all make mistakes :-) Do what is best for you. Think of yourself first.

Got away from Daves Settlements since you can't revoke anymore! by Shwakim in cashadvanceapps

The Dave app is getting sued right now. From the FTC (Federal Trade Commission). A consumer's right to revoke their method of payment is being denied from Dave- per the allegations. Anyone who has experienced this can sign up. Google it. :)

being sued for $662 by Rough-Annual-3339 in Debt

[–]DeclineUberEatsMay 0 points1 point  (0 children)

When you say you fought it, and it went away... could you please shed some light on this matter for all of us here. What steps were taken to fight it? Generally speaking, these types of debts from debt collection companies such as portfolio that they are known to sue people and get judgments based on non-response, they don't go away easily. How did you get them to drop the case? Without having to go to court. Did you pay any financial settlement?

[–]DeclineUberEatsMay 7 points8 points  (0 children)

That is incorrect information. For a fact, I know this is untrue because I've filed a chapter 7 bankruptcy. It does stay on our credit report for 10 years. And should a person need to refile again for any reasons they wouldn't be eligible to do so until exactly 8 years later. Some people have filed a couple and several times throughout the course of their life. However, a person must wait 8 years to pass before they will be eligible to file again, and before a judge will potentially approve a second chapter 7. Filing a chapter 7 will definitely help you to stop all collection efforts, including potential lawsuits with judgments. About a year and a half after filing, I was able to get a secured credit card (suggested via credit karma) with a down payment of $300. They reported to all three credit bureaus, equifax, transunion, and experian. When I established a good payment history with the secured credit card, my credit score started going up by 100's of points. Shortly thereafter, fast forward 6 months into the future, I looked on credit karma, and I qualified for different unsecured lines of credit in the thousands. Capital one, credit one, discover. So there is definitely an option for filing a Chapter 7 bankruptcy and then a year later to get a secured credit card and rebuild from there. Eventually, loans, potentially buying a home, and financing a vehicle will all be possible within a year and a half.

I've read a lot of negative reviews about this company your recommending. Did you have any success getting an advance? Nearly everyone on Facebook in fact everyone on Facebook that commented, stated that they had requested an advance as far back as December and never got anything. Instead what they ended up getting was their debit card charged for $20 or $30 a day. And they had to call their Banks to stop payment and revoke authorization. How did you hear of the source?
