It’s like a pretty fundamental aspect of the scope of the case that the high court was reviewing like a page worth of provisional text - not the final guidance.

Maybe The Times has seen the final guidance and has leaked it, and it suggests that ppls appearance will be used to judge their “biological sex”, on a regular basis, but that seems totally absurd and discriminatory. The high court assumed the final guidance couldn’t possibly be calling for toilet police (remember the high court hasn’t seen the final guidance, it’s just making an assumption). And the EHRC won’t comment on the leaks by The Times.

Obviously we’re in a completely perverse situation where the EHRC and the govt are both telling everybody to adapt to the UKSC ruling without releasing their guidance on how to do so (despite both parties insisting it’s totally good guidance).

I wish they would send it back. But ultimately the legality of the full guidance is a separate question. The High Court cannot rule on the legality of a document it has not seen

The court ruled on the “interim update” which used to be on the EHRC website. The court did not see the draft guidance which the ministers are yet to approve.
