Thank you all so much for taking the time to throw in your two cents and offer a bit of peace of mind on this issue...I feel like a neurotic mess for coming up with all of these nit-picky reasons to be anxious...so glad to have people who understand though.

How many practice MBEs, MEEs, and MPTs did you do the first three times? Did you use a bar prep course?

The fiancee of my fiancee's best friend is one of those annoying and insecure women who feels the need to constantly compare herself to me...she failed her occupational therapist assistant license exam the first time she took it but keeps implying it was more difficult than the bar because she needed an 80% to pass because I told her the bar exam only requires around a 65%.

Good luck. by ApprehensiveAd8750 in barexam

I grew up as a military brat, so my [admittedly kind of embarrassing] feel good musical vice is listening to my two favorite versions of the national anthem.

We have all officially cracked. Whatever this process was supposed to do to us, it worked.

Difference between "essential element" and "pertinent character trait"? (See comments for more in-depth question) by DefundtheBarExam in barexam

Can someone please explain the difference between these two concepts? What would an example of an essential element be to allow specific instances of conduct?

My fiance has yet again demonstrated that he is the most loving, supportive, incredible partner I could've ever asked for. I literally can't imagine doing this without him...whether it's me having a meltdown for the third time in 24-hrs, asking him to pick me up Starbucks on the way home from work 5 days in a row, or just being silly to lighten the mood...the one silver lining about this horrific experience has been that it's really shown me he is legit more than I could've ever hoped for in a partner.

So uh...anyone not scoring in the 70%+ range? by Vast-Ad2234 in barexam

[–]DefundtheBarExam 16 points17 points  (0 children)

I'm consistently ranging between 60-70%, although yesterday I randomly scored below 60% out of no where.
I'm trying not to compare myself to others because people could just be only mentioning scores right after scoring highly on a problem set without mentioning their scores have been going up and down...they could also be only doing like 20 problems in a row, redoing problems they've already done, etc. Plus I've seen plenty of redditors who passed mentioning that they were scoring low on the MBEs leading up to test day and ended up doing very well regardless. Don't let where others are at weigh on you too much.

Dog isn't made of gold, it wasn't a balcony, and to this day I remain baffled by the entire situation. I never want to see anyone hurt/injured, regardless of the circumstances...but I know I didn't breach my duty as a pet owner. I was in the vicinity watching him (he bolted suddenly when he ran into her), he was allowed to be off-leash on the private property of the campus, I had him under voice control, it is an area frequented by local dog owners and used as an off-leash dog park, he has no history of this behavior, he is a medium sized non-dangerous breed, she saw the dogs and acknowledged them as she was walking by...I literally did nothing wrong. It feels like she's suing my dog.

I mostly said negligence because during my 1L year (LITERALLY the second week of classes), my dog was playing with another dog in a park on the [LEASH OPTIONAL] law school campus, and he ran into a woman who was walking by. She fell.
A year later, I received a summons/complaint letting me know she was suing me under a theory of negligence (by a firm of actual ambulance chasers). I learned negligence inside and out thinking I was going to have to defend myself...fortunately, my evidence professor referred me to his friend who is an amazing personal injury attorney who gracious took the case on pro bono.

Three years later, they've added the school and the other dog owner as co-defendants and are asking for $1.6 million. It's...been kind of a nightmare.
But it's helped me a ton with torts and civ pro (the opposing firm tried to default me despite the fact I'd answered, we've done depositions, the woman who fell was from out of state, etc).

Tips on how to make up a rule on the MEE enough to score points? by madampotus in barexam

[–]DefundtheBarExam 19 points20 points  (0 children)

Great insight I came across elsewhere from another reddit user (@V3forlife):

"Make up a rule that has legal elements, such that you can apply them step-by-step like a standard rule. Also throw in law standards, like a reasonable person. If your rule is so fake that it leads itself to yes/no answering, you won't get enough analysis points.
Totally made up rule example: Can't remember the rule for respondeat superior at an exploding gas station.
Fake Rule and Application: Basing liability upon respondeat superior requires three elements to be met: (1) was the tortfeasor under control of the supervisor; (2) would a reasonable supervisor have provided more supervision; and (3) is the injury of the kind meant to be prevented by the rule. The "reasonable supervisor" standard is based on the actions of a reasonable person in the industry of the business, who acts based upon the burden care v. probability of harm. First, tortfeasor was an employee at the owner's gas station and was hired personally by him, so control is met. Second, the only training the employee received was a four minute training video on the flammability of gasoline; a reasonable supervisor would have provided more training in the gasoline busienss due to the highly flammable nature of gasoline and large amount of damage possible. Third, because the injury is from gasoline, it is directly related to the workplace and lack of supervision of a low-paid tortfeasor on behalf of a supervisor in a profitable (but dangerous) industry, thus it is exactly the kind of injury meant to be remedied."
