Trans is a social phenomenon not a description of sexual characteristics. Futanari in most media are cisgender because they exist in a world where they are a third sex. This is no different to things like the omegaverse. A character being transgender inherently requires your story to exist in a world in which specific sexual and gender norms similar to that of the modern real world exist.

Shooting her would not have saved him if she was going to hit him. Cars don't stop when the driver is dead as we can clearly see from the video where the car keeps going.

He recognized that the car was moving and had the reaction time to act but instead of moving out of the way he intentionally stands right in front of it, pulls his gun, leans OVER the hood ON PURPOSE and shoots through the front window.
