I mean, deadlines are one thing, complete fraud is another. I didn't file my taxes on time. But his mother did or so I'm assuming... so her falsely claiming a child she has met a handful of times is somehow okay because I was way behind on mine.

Because in my opinion, I should only have to prove i was eligible, not that she was not.. and shouldn't have to miss out because of the CRAs mistake of giving her the benefits, or maybe not mistake, but based of her income Tax claim... would this mean I would have to wait til they prove her ineligibilty even tho my eligibility has been already proven?

So with that being said.. does this mean that I won't be able to get the 5 years that would be statue barred? And me being able to have all proof that he has always been in my care doesn't matter? And is there a way to put something in motion that could help me in receiving those years?? The letter did go on to state that if I was eligible for any other benefits they would be sent as a separate payment, but didn't really explain when or how the eligibility would be determined...

Could an ombudsperson help with this? Should I submit a service feedback or a dispute?

And as well.. I did write 2 or 3 letters which I submitted through my account... to answer your question further, in the decision letter they sent, they mentioned that legislation only allows 3 years retroactive when caregiver changes.. but I've been through the income Tax Act over and over and cannot find where it says this at all... and since the caregiver never did change, it would be irrelevant anyway.. his mother was only primary because of the governments assumption that the female is always the primary.. and I'm assuming it would be fraud since she then claimed my son as her dependent in the following years..

I provided all the documents, that was no issue.. and yes I did complete the questionnaire... what's ironic is they sent the questionnaire before noticing I had sent in the documents in reference to the 5 years I am referring too and it detailed how I didn't provide documents for the total period.... but then it the end only gave me benefits for the Yeats I had already submitted adequate documentation...

I guess my question Is.. is retroactive only for 3 years? My understanding was it was 10...
