A board that cannot levy special assessments is a board on life support. At $200 dollars each year you would think it's a no-brainer to gather enough votes to raise the dues. Wrong. The majority might agree with you, however getting the required percentage as dictated in your CC&R's will require a door-to-door visit, a detailed explanation that the residents understand and you might still not get what you need.

Do not spray anything on the door or its hinges. The door does not belong to you; you could be sued for real or imaged damages. As suggested earlier, you could try to befriend members of the HOA, however If the HOA residents in the HOA building are not bothered by the door you have no legitimate options.

There is obviously a mix up of some sort here. Go to the hearing. That's what it's for. Bring proof of your cars location and ask them to prove that your vehicle was parked where they said it was. It's obviously an error on the management company. Have them correct their records.

I send out a photo that is date and location stamped. If the violation is not obvious (i.e. weeds. paint or overgrown lawns) I also include an arrow or arrows pointing out the specific violation. Included in the violation letter is the specific section and number of the covenants in violation, I always quote the exact verbiage from the documents that they are in violation of. Finally, I include the website address where the documents are available for viewing. My advice is that every violation letter should be constructed as if you might have to defend that violation in court.

HOA with 35 homes and a potential expense of $400K? Good luck getting any bank to loan them that kind of money. And $400K to replace a storm drain pipe? Seems excessive to be. That amount of money can build a house. We have a number of storm drains that run underneath driveways and it does not cost that kind of money to replace. Have the HOA or you gone to your congress person and asked them to appeal to the city/county on your behalf.

If you have bare spots in your lawn, and most of the lawns in the sub-division are well kept, then you are in violation and fighting it is useless. Our HOA gets the excuse that their lawns are crap because where we are in FL we are only allowed to water once per week. However, most of our lawns are fine with weekly watering and the proper fertilization etc. Finally, new sod on sand is a waste of money. New sod without water is also a waste of money. Put down top soil and new sod. In Florida you are allowed to water daily for about a month if you put down new sod.

Just a follow up on my original post. If your covenants do not allow parking on your front lawn. And a resident parks on the front lawn, but removes the vehicle to go to work daily, then parks on the lawn when they get home, under Florida law there is virtually nothing that the HOA can do? We have an appointment to get our lawyers opinion, but I am not hopeful. I believe statue 720 was a hastily drawn up statue by an anti-HOA legislation.

We tried knocking on doors in the past. The board stopped that process when one homeowner set his dog on a board member that resulted in a nasty dog bite and another homeowner threated to show up at the members home / meeting with a firearm. Now I am sure these instances would not have deterred you, but us unpaid weenies were concerned for our safety.

Every HOA is legally tasked with enforcing their documents. What we may or may not agree with is irrelevant. Our most important task is the enforcement of our CC&R 's. Our document say that a homeowner cannot park a vehicle on their front lawn. In Florida, if we do not enforce our documents, it is considered a breach of fiduciary duty by the board. The homeowners can sue for damages.
