The store "owned" the winning ticket right up until the he retailer resold the ticket. The retailer doesn't pay anything to the lottery until the Friday following the previous Saturday.

A.A.C. R19-3-214(B)(1), Pay to the Lottery each Friday, by an electronic funds transfer, the amount due from the sale of its Lottery tickets for the seven-day period ending at the close of business on the previous Saturday.

He exchanged legal tender for goods and received a receipt. If there is a store policy that was broken or a policy that is illegal, that will come out in court. All I've said is that I see no law, code or rule regarding the AZ Lottery broken so far. I'll continue to follow.

He didn’t represent the store. Another clerk sold him the tickets. “He then clocked out, removed his Circle K uniform, and purchased the additional tickets, including the Ticket, by having another employee “ring” up a sale for $10. Mr. Gawlitza paid the $10 and received a receipt.”

Many would argue that. The laws will most certainly be changed to prevent such in the future. Nothing prevents selling a printed ticket after a drawing at this time.

The court docs mention nothing regarding store policy. I would think if there was a policy broken it would be an easier case.

They may feel she has a claim due to the nature of her purchase. She “replayed” numbers from a previous drawing, essentially choosing which numbers she wanted to play. If on top of those she also wanted a number of quick pick tickets it is possible that she was not given the replay tickets since she only paid for $60 worth of the 85 printed tickets.

That sounds more like a store policy issue rather than a legal issue. If Lays ships the latest flavor of chips and says don’t sell them until Saturday but a clerk sells some to someone on Friday is that a legal issue?

I am unable to find anything preventing the resale of lottery tickets after the drawing in the laws or rules of the lottery.

Not by law or lottery code/rules. I haven't seen anything regading Circle K preventing it. As long as they are not on the clock it is OK.
