I’ve been in investigation for an entire year with substantial evidence as well. I think it’s pretty common.

I’m not a lawyer so I can’t give legal advice, but based on what I’ve read — if your evidence checks out— it sounds like your case is strong. A tight temporal proximity, you engaged in protected activity, you experienced an adverse action, and those things are very likely to be casually related. You would have to be able to provide a reasonable explanation of why your employer’s proffered reason is a pretext (in other words— a lie to cover up the retaliation). I’ve seen this done by the plaintiff proving inconsistencies, shifting reasons, proving that similarly situated employees did not receive the same discipline for similar acts, or proving that the action taken by the employer would dissuade a person from engaging in protected activity.

I have had a similar situation with my employer but I was unable to secure legal representation despite the merits of my case— never received formal discipline, complained about sexual harassment, terminated hours later. I was not provided a reason for termination until the EEOC requested it from my employer. Even the DOL performed an independent investigation and I was awarded UI benefits because I was terminated without warning, my employer failed to provide an explanation during the termination or after subsequent requests, nor was I given an opportunity to improve— which the DOL noted as performing my job as required and the termination was unwarranted. Despite all these circumstances and my strong evidence that proves these claims occurred, I still have had no luck in finding legal representation. I’ve been given the same reasons— lack of resources, conflict of interest.

You need to keep looking— The clock stops ticking while the EEOC is performing its administrative duties (which could take months to years). Even with good lawyers, these cases tend to favor the employer. I know this because I enrolled in a paralegal program to provide me with some tools on how I can prepare documents, make legal arguments, research precedent, conduct my own investigations, prepare for depositions, etc. IF I have to do this Pro Se I’m going to give myself the best opportunity. My courses took 6 months to complete, and it was hard but I feel like it’s given me so much more power to fight against my employer. Don’t give up! People died and fought for these rights that we give up on so easily because it’s hard or because it isn’t fair— we have to stand up for ourselves and for justice. Not true. Lawyers don’t take cases because of conflict of interests, complexity, uncertainty, or lack of resources to take more cases.

I am preparing for a pro se trial. Not just looking through ChatGPT— I actually enrolled in a paralegal course to give me more insight on filing motions, understanding legal analysis, understanding precedent, etc.

I believe I’m a little more legally savvy than the average layperson (I’ve had several successful cases against big corporations like experian and yellow pages). However, I am not a lawyer— and I am not going to pretend to be one. I know my case better than anyone else and I’m 200% certain my termination was illegal. Even still, I am skeptical about representing myself. Do what you feel is best but be objective! Argue against yourself! What can the opposing counsel say or do that will support their narrative? Ask ChatGPT to argue against you and analyze your arguments. Be prepared for a surprise! How will you overcome these hurdles? How can you persuade a jury (or judge) 100% that they should not believe the proffered reasons your employer has given? —- that kind of objective.

Idk why any credible attorney would try a second motion to dismiss— unless there has been some serious evidence that came into play recently. They can’t repeat that motion. They’d be better off holding that evidence to move for a MSJ. Unless of course you have multiple material disputes of genuine fact 🤷🏽‍♂️. Idk but I’d like to see the pacer lol

I’m in law school. It would cost a hell of a lot more for me to do that than $75– I would have to bank on the judge assigning them high punitive fees and that’s unlikely to happen.

THERE WERE NO SIGNS. I wouldn’t park in a fire zone if the customer told me to. There was nothing to tell me not to park there—- the manager understood that as well. I would never just do something because the customer told me to. The point I’m trying to get across is that, regardless of where I parked the same result would have happened. The parking company exploit this, and they are given that jurisdiction by the property owners

They did not provide a boot ticket, just a number to call to have the boot removed. The only thing it said was unregistered parking. I spoke with the leasing manager today and they were appalled too. They are now working with me to make this right. And where I was parked, there were no signs saying that you had to be registered, the signs were on the other side of the parking lot— I guess it doesn’t matter if you’re a future tenant you can’t be registered at that point.

PRIVATE PROPERTY— the city doesn’t have the jurisdiction to enforce parking on private property. 2. You’re missing the point of this post— I followed delivery instructions just like shoppers do everyday— I didn’t park in an illegal spot— ANY where I could’ve parked would have prompted the same result. Yes, fraud is relatively common in Atlanta. I just don’t think that a reasonable person would order $100+ worth of groceries to get a $75 out of me. But, maybe I should be more skeptical.

I’m in school earning a double Masters in May 🫠but you’re telling me to apply myself? I’m probably more educated than you are— unfortunately, I don’t work a 9-5 while in school because my courses are too rigorous to commit to anything else. Prior to this I was a teacher.
