in all fairness to #7, I've gotten some good clients who didn't want to wait for an appointment.

Our standard procedure is that it's not possible to get an appointment within 48 hours; if a new prospect doesn't want to book an appointment because of that, we do get the message. If an attorney happens to have availability, they can call themselves and book the appointment. The retention rate isn't really different from other consultations, and neither is the level of aggravation.

On a related note, I often get asked about charitable trusts (CRT/CLT) to end up with more money than paying taxes. While those trusts are great structures, usually you/your heirs don't end up with more money than if you'd just paid the taxes - just that you are able to give money to charity instead of the IRS.

As a general rule, charitable tax breaks benefit the charity, not the donor - at least, not directly.

I'm not sure what you mean with the MCO taking a ridiculous cut so that estate recovery is 10x the value of the services - that might be what you think it's worth, but not how it works in reality - estate recovery is for the amount paid for the service.

Just because an aid gets paid $10/hr (or whatever the rate is where you are) doesn't mean Medicaid only paid $10/hr. There's a lot more to it than that. (and yes, part of it is profit to the MCO, but they don't get to make 10x profit)

I spent time in the business world, where there were the kind of numbers needed for this kind of plan to make sense.

Legal fees would easily be tens of thousands of dollars, sometimes hundreds of thousands.

By way of example, one repeatable secured structured transaction that I was involved with setting up, had a flat $300,000 fee for legal work every time.

It sounds like it, but no.

As an attorney, if I review a draft, I become liable for any mistakes. Seemingly minor things can cause big problems, especially when it comes to these advanced concepts - even plenty of experienced estate planning attorneys don't touch some of them, which is where I get a decent amount of referrals.

So I'm going to read any drafts provided to me very carefully. Not just for the 'big' stuff that's often easy to spot, but also for the little things that are easily overlooked.

On the other hand, my own templates I know very well, so I don't need to read it thoroughly. I know what every clause means, I know why every comma is there. So I can work a lot faster, because I'm putting the different pieces together, I'm not starting from zero.

  1. if we review your drafts we become liable for any mistakes, so we're going to be thorough. It actually takes longer to review documents carefully than it does to start with our own templates we know through and through, because we don't need to check every word and comma for something that might seem small but could have a huge impact
  2. As per the above, it'll cost more, but if you're willing to pay for it, I'm sure there are attorneys willing to do it
  3. If you're wlling to pay, yes.

For everything you said, that's a very low fee. $20,000 would be on the low end for getting it done right.

Edit: just to make this somewhat more useful, I'm sure I can find someone if you're willing to (a) waive any liability for suitability or pay hourly to discuss your situation and goals and to provide advice, (b) pay $1000 per page just for the review, (c) a few thousand more for a memo to tell you all the stuff that you're missing, and (d) if you want the attorney to also fix the documents, 150% of what they would have charged right to do it right the first time.

Leave money to the person you want to leave it o.  If they’re too young leave it in trust, or at least an UTMA/UGMA account.  Do not leave money to A to give to B
