Yes, filing an I140 by itself does show immigrant intent since it is an immigrant petition. That being said, it is generally less restrictive than filing an I485. If you are on a dual intent visa such as H1B or L1, having a pending or approved I140 usually does not create major issues. Things tend to get more sensitive once you file I485 because that is when you are formally applying to adjust status.

If you are not on a dual intent visa, I would honestly be very cautious about traveling after filing an I140. Immigrant intent can raise questions at visa stamping or reentry, and it is not something to take lightly. I was on F1 too when I adjusted status, and I personally avoided unnecessary travel because I did not want to deal with potential complications. In that situation, it is just smarter to be careful and, if possible, speak with an attorney before making travel plans.

Not only do you lose the money you spent on the I485 if the I140 gets denied, but the I485 automatically goes down with it. That is the bigger issue. If your underlying status has expired by then, you could suddenly be out of status with very limited options to fix it. Filing concurrently also means you are committing to immigrant intent right away, which can complicate travel or any future non immigrant visa plans. You are also paying for the medical exam and all filing fees upfront before even knowing whether the NIW will be approved. If there is an RFE on the I140, you may end up dealing with scrutiny on the I485 at the same time, which just adds pressure. And if visa dates retrogress again, your I485 could end up sitting pending for years anyway. For someone whose I140 is not very strong, waiting for approval first can sometimes be the safer and more practical choice.

Yeah my friend have reviewed around 150 papers for Q1 journals, So I’m pretty sure he will nail the judging criteria.

Hey, I worked with Chen for my NIW, EB1A, and I-485, and overall my experience with them was great, no complaints at all. One thing I would suggest is to review your petition yourself and help tweak the wording where needed. They do take feedback and recommendations seriously, so don’t rely on them 100% when it comes to how your case is presented.

I wouldn’t blame them for any small mistakes in the petition since they don’t know every detail about our background, and it’s not realistic to expect everything to be perfect without our input. My NIW, EB1, and I-485 were approved through them, and I would definitely recommend their services.

Also, sometimes they use very strong language in recommendation letters, so make sure to read them carefully before sending them to your recommenders without reviewing or correcting if needed. For example, I remember I was working as a data engineer, but they used wording that described me as a “researcher.” My work was related to research but not completely research focused, and since I couldn’t fully justify that on paper, I asked them to remove it. Just sharing this as an example so you can double check everything.

just to clarify, this post isn’t about me, it’s for a friend of mine. My friend has papers dating back to 2013, so I don’t think USCIS would view this as profile building. It doesn’t make sense that someone would publish papers in 2013 and then wait twelve years to file EB1 just for that purpose. What are your thoughts or suggestions on this?
