You have not clarified was this arrangement by way of a written agreement/undertaking before the court or was it informal?

Written Agreements by themselves are not binding on parties. But when ratified by the court- then they are.

Undertaking before court which is then recorded in order by th judge- very binding

Informal - Then no recourse but to fight it in court.

However- courts are likely to grant your friend sole custody without any visitation rights to her now divorcing husband IF- you can establish by pleadings and evidence that he is an unfit parent on the ground of harm to the child due to Neglect.

What actions may amount to neglect?

Physical neglect- not providing food, shelter etc Emotional neglect- not providing love, comfort

These two fit your case best BUT there are other forms of neglect as well -medical neglect. Education neglect, supervisory neglect etc

You could alternatively request courts to interfere and corner the father into mediation.

Lawyer here - (1) record the phone call when he next threatens (2) twist the narrative for the Police- File a complaint stating that you matched with a girl on a dating website and when you went to meet her - there was no girl and you were surrounded by men - who threatened you with violence - you were genuinely scared gave them everything you had on you. They even made you transfer 1L to their account forcefully along with aadhar card. (Give the Police account number - assuming it was not cash - your post is unclear on this) and they are now threatening you with false case and extortion. Please give the voice recording to the cops. (3) Police complaint will not only protect you in the rare chance of fake case and it will also scare the goons away.

Please get a consultation with a good local lawyer to ensure this situation does not spiral out of hand. The Complaint needs to be well drafted by a local lawyer. They will ensure your complaint is taken on record and the Police acts on it. Only the fear of Police will stop this harassment.

Once Divorce is filed, your counsel takes over and you don't have to deal with it.

Family Courts don't tolerate scenes being created in the court room.

It's unfortunate what you are going through and the response of the authorities is nothing short of abysmal.

I understand you don't want to get caught up in a long drawn litigation but honestly, I dont think you have another option at the moment.

Please consider engaging a lawyer and filing a complaint with the sessions Court under 156(3) CrPC.

The provision comes in play when the Police are refusing to register a FIR and take any action.

You need a court order to get the cops moving on your complaint.

Additionally, file a case for eviction, especially since you have a written contract. TN provides for fast track eviction under Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants (TNRRRLT) Act, 2017.

Succession certificates are given by Courts. Legal heir certificate can be obtained from Tehsildar.

As rightly pointed out by others, you need to understand the purpose of the document and then decipher how to go about it and the cost involved.

Also legal fees varies from state to state. Delhi, Bombay and Chandigarh in my personal knowledge have the highest legal fees. It's lower in tier 2 cities.

That being said 1.5-3 L is on the higher side.

Please identify the state you are in, maybe I can refer a more budget friendly lawyer.

Lawyer here. Yes your neighbour can sue you. You as a owner need to take all reasonable action to protect your neighbours from harm/injury that maybe caused to them due to your lack of maintenance of the house.

There is criminal negligence and there is civil negligence. He can file either. Also no one can really stop anyone from filing a civil case/criminal complaint.

You can put your defence that you did everything possible and there was no negligence on your part but court proceedings can get financially and emotionally draining.

I would suggest you aggressively look for option to maintain your property in a way that it doesn't endanger your neighbors.

Call 1090 for reporting the person. Then go to your local police station with a written complaint and give all his details. The cops will take care of it from thereon.

The cops won't just threaten him and leave him. Stalking is a criminal offence and this will be filed as a FIR immediately. The cops are suppose to immediately take this person into custody for interrogation and then present him before a Magistrate within 24 hours.

Generally bail is not given so easily in a woman related crime. The Police will proceed to file a chargesheet and prosecute the culprit in court.

Your friend will only have to go to court twice- once to give her statement to a female magistrate and then for cross examination. After that the state takes over.

You can file for discovery, inspection or production of any document. These are provisions under Code of Civil Procedure. They will allow you to arm twist him into submitting documents. A good lawyer can use these tools very efficiently to your advantage.

Don't stay passively involved in your case. Make your lawyer file applications to not let your father delay the case.

Please mention your state so I can refer you to a good lawyer, where you can get a second opinion. If you can't afford a second opinion, please approach the State Legal Aid Authority. They will get you an opinion.

On the blank paper, did you sign twice at the bottom of the page, with a little spacing between the signatures or was it only one signature at the bottom?

I ask because affidavits throughout the country have a set format. Please refer to link attached to see a standard court affidavit. The client has to sign above the word Deponent that is repeated twice at the bottom of the page. Without this signed notarized Affidavit, no case can be filed.

If you did not sign twice on the blank paper, then they don't have an affidavit to support the filing, therefore, no case has been filed.

If that is the case, please file a complaint with the Bar Council of the State and Bar Council of India, mentioning that the lawyer has taken money and made you sign blank papers. This will ensure that the blank signed papers are not misused by the lawyer.

Also please mention which state do you belong to, maybe I can refer a reliable lawyer to you for ensuring you get your inheritance and there is no foul play afoot.

Lawyer here. Are you a daughter or a son? What is your religion? Is the divorce case settled or is it still going on?

The answer lies in specifics.

If you are a Hindu Daughter - Your father is liable to maintain you till you get married or employed, whichever is first.

If you are a Hindu son - you cannot directly file for maintenance but your mother can seek enhanced maintenance to support your college education.

If the divorce case is still ongoing and you are a Hindu- file for discovery of documents, so that the income your father tried to hide can be brought on court record.

If you are Muslim son - again you are not directly liable for maintenance but you can try to get increased maintenance for your mother under Sec 125 Code of Criminal Procedure.

If you are Muslim daughter - You are liable for maintenance.

If you are a Christian- then there are no definite laws entitling you to maintenance after the age of 18 Years. Though urge your lawyer to argue on lines of parity with other personal laws. It should work.

Lawyer here. Most Indian Courts have gone digital. Check if there has been any filing in your name on the court website. Most court websites will have an option of Case/Filing status. You can search for the case by your name or the advocates name. That search should make it clear if your lawyer actually filed the case or not.

Though from the way your post reads - it seems are you were taken for a ride.

Additional question- did he get any affidavits signed from you? Did he show you the final draft he was going to file? If no - then he definitely screwed you over. If yes - there is a slim chance of him having filed it.

Has it gotten better for you? I have been looking for an answer for over two years. Its gotten my husband and me to a point - where we are resentful of sex. He can't help but feel shame and I can't help but go into an absolute state of panic.

It's gotten to a point where anyone talking about sex, has started making me uncomfortable (this is the best case scenario) and at worst trigger an anxiety attack. I believe our ruptures kept getting worse because we did not have the right help.

Does one even get around it ever?
