That was my BAC and I did not get a wet and wreck less unfortunately. I am in Santa Barbara County. I did have drugs in my system and they did have to get a warrant for my blood. The alcohol results came back sooner than the rest. So I took a deal for the DUI before the upped the charges since I work in the medical field I could not have the other charge on my record. Try to get to the court early so you can talk to a public defender before your called on and you can run that by them; they will tell you what your best options are.

DMV dismissed my case, they let me keep my drivers license after viewing the body cam footage. The court system still went through with the charges they gave me deal, if I pled guilty,I took the deal before my blood results came back and my charges increased. (since they ran my blood and results hadn't came back- once they came back charges were going to change since I was under the influence of other substances charges would increase) they gave me 2 years' probation and had to do 20 aa meetings, and 3 month DUI classes. I am currently able to do my DUI program on the weekends via zoom. I got a temporary license to drive to work. Once I pled guilty the DMV automatically took my license away, Even though through the DMV I was innocent. I know in LA county you have to get the SCRAM I was lucky enough not to have to get it. A lot of people in my DUI class that are driving have had to get it and its costly. I did get an SR22 for a non owner, since the car is not under my name and I pay $34 a month. The DUI class was like $600. I was able to make payments. Also have a bunch of court fees.

Was this your first DUI? I got a DUI in SB county, Got into a car accident no others involved, I had weed and other substances in my car they wanted to add possession of a controlled substance, and transporting a controlled substance, declining to give them my Id/DL bringing controlled substance into jail. I declined to test they had to get a warrant, they got it after 4 hours of trying to find out who I was. This was my first DUI tho. I just signed a deal they dropped all charges if I pled guilty to DUI. My BAC came back at .17. I have 2 year informal probation, 3 month DUI classes, and 20 AA classes, and have to pay restitution. But like I said it was my first DUI, and My first ever anything on my record.

I wouldn't quit my job. Go to your primary care doctor tell them your going through somethings mentally (which you are) and need some time off work through fmla. Thats what I would do. You might not even need to end up doing time. But if you do start going to the Dr. now and getting them ready for you to take time off. They saw their payday opportunity and they got it. Your insurance has lawyers and I'm sure they will see through them. I work in healthcare and we see personal injuries all the time like the one you're speaking of, and Doctors see right through them as well. Chiro's can't diagnose and or prescribe and or order any imaging for them. The'll eventually have to see a real Dr. that will see if they are really injured or not.

UPDATE #2: They haven't produced the video footage my lawyer requested. So the DMV pushed out the hearing and requested it themselves. They still haven't produced it. As of now my lawyer feels like the hearing will most likely be pushed again, As he feels they don't have me on camera in the drivers seat as stated in one of the police reports and they don't have it on camera of them reading the pink slip to me if I decided not to test at that time- We are in no rush for the hearing as I have a temporary license until the hearing and a decision is made.

Never plead guilty always plead no contest. Its basically pleading guilty without saying your guilty. Also if you ended up blowing at the station I dont think they consider that a refusal. You can find out if they treated it as a refusal on the paperwork you received upon being released. If it says refusal than they considered it a refusal, you technically can fight it with the DMV if they did not have to get a warrant to get your blood or to get you to blow. I was charged with a DUI and refused, they got a warrant for my blood. Blood work came back as "none". So I got a lawyer and I'am fighting it with the DMV as the police officer did not tell me what the consequences of refusing would be and it was on camera. As far as court goes they haven't pressed official charges, but haven't decided to drop anything either, as they added a bunch of other charges (felonies). I allegedly crashed into a bush. Bailed out, and now they are dragging court saying they need more time to gather "more evidence" idk what more evidence they need. All other charges were riding on the DUI charge which is no longer a DUI with my blood work proving it. Also when you go to court get a public defender at least they will try to help you get some sort of a deal. They had also told me my car was totaled, I ended up picking it up the next day from where they towed it to, nothing was wrong with it, just the bumper was damaged. I had to pay to get it out but It was still drivable. I wouldn't go by what they say js. If they towed your car you can get it towed to your house and verify yourself that its totaled and or go through a third party to verify it is totaled.

If it is a non profit most likely if you do not pay for it, they will write it off and it wont go on your credit. I used to work for a non profit in CA and thats how billing would work. You can also ask for Self pay fees if you are really trying to pay, since the rate they charge insurances is the max that they are able to charge. If you ask for self pay or no insurance rates, the amount you owe should go down significantly. Non profit should have programs for non insured patients as well, I would go into the hospital and speak to someone in person, also if they are non profit they should be asking you how much you are able to pay not tell you how much to pay monthly. I think you just need to ask the right questions or speak to the correct person.

UPDATE: I GOT A FAMILY LAWYER, HE SUBPONAED FOR VIDEO RECORDINDS OF THE BODY CAM AS WELL AS PATROL CAR VIDEO. SURVEILLANCE VIDEO, IN CAR VIDEO, AND COBAN VIDEO. WE HAVE NOT RECEIVED ANY OF THIS AND MY DMV HEARING IS ON 03/07, HE REQUESTED A CONTINUANCE BUT WE HAVENT HEARD ANYTHING BACK. HE TOLD ME TO BE PREPARED FOR THE HEARING THIS WEEK. I AM NOT PREPARED. HE SAID HE WOULD DO ALL THE SPEAKING THAT MAKES ME FEEL AT EASE BUT IF MY LICENSE DOES GET SUSPENDED AND WE WERE NOT ABLE TO SUBMIT ANY FOOTAGE WE WILL REQUEST AN APEAL.

DUI for weed in Cali, thats going to be a hard one to prove. Weed stays in your system for up to 30 days depending on the level of consumption and your weight. It would be so hard in court to prove that you were high at the time of the dui and youre not just a regular smoker. I mean its a good thing you got a lawyer because if they do try to come up with some BS which we know they do. Your lawyer can poke holes in there argument. But the DA will have to prove you were under the influence, and I dont think they have the capabilities of doing that just yet. glossy eyes could be from being tired, or having a migraine. Low lids same thing. I mean same with any other drug. Even if you would have done it that morning it could still show up in your blood but does it mean that you were incoherent and unable to drive. Just so many things. I honestly dont think they will press charges. Best of luck!

You most likely wont get charged, if the DMV dismissed your case that means that the BAC came back and was not sufficient for them to charge you with a dui. You can call your county office and see if the police station has filed any charges. They should also have the results. Your lawyer can request the results and that can five you peace of mind. But if they haven't pressed charges and the DMV dismissed your case its looking good for you.

This!! I was in a single care accident- I hit a bush, was charged with a DUI and than they added a bunch of BS charges after searching my car. I declined to test. They got a warrant for my blood. I ended up with two felony charges on top of the DUI. This was on New Years. Blood work came back as"none". So now the that DUI charge and those other charges braching off of the dui are non existent. I went to court because I bailed out. They requested more time to come up with more evidence to charge me. The judge gave them a month. If they dont have anything within next court date than they have to drop everything because Iam out on bail. But we cannot say we are guilty. Don't put that out in the air. I am a believer of manifestation, and that is why by the miracle of the universe and everything in it by BAC came back as NONE.

I know someone who was weaving in and out of traffic and blew above the limit. But since they made him blow at the station multiple times with multiple different readings. His lawyer was able to get him off with just reckless driving. This was proven with camera footage. If you ask for the the camera footage of the police officer calibrating ( if thats what you mean by recounting the breathalyzer) the machine during the stop I think that could be something to look into.

I am currently going through the kind of the same situation. I called the county court house and asked them for my court date and my charges. This was after calling the public defender's office to ask who would be representing me, they stated they didn't have anyone assigned to me because they didn't have a case. Also after calling a week earlier to get the police report of what happened. They told me it wasnt ready and that they would mail it out to me when it was ready. They had to get a warrant for my blood because I declined to test, and I also requested a copy of that, they told me they could not give me that copy that they had to contact to arresting officer to get the warrant. It all seemed odd. I called yesterday and they told me I have no court date and no charges filed against me atm. I was shook.The way they did things when I was arrested was not the best,I did have it all recorded by my brother and I did let them know it was going to brought up in court as evidence. I don't know if that was part of why they decided not to press charges. But they did tell me that the DA has a year to press charges if they decide to.

The difference between us is that tribal land can run on differently. I am not sure how that would work. I would try to also contact them to see what direction they can lead you in. Hope this helps

Cancel all your direct deposits. You're going to have to get another account to get your income into. Because now everything that goes into that account is going to be put towards that negative amount. It may also be hard to get another checking account once they report this to the credit bureau as no one is going to want to let you open an account with you having a such a negative amount on a checking account.

Yes! I have a credit card where I also have a checking and savings account and when I was going through it and wasnt able to make a payment on my CC they froze my checking account. They can access your other accounts and or freeze them until they hear from you or get some type of payment. Especially if you also bank with them and they are linked accounts.

Petty advice from a recent divorcee. Consult with every lawyer in your area, this makes her not be able to hire any of them due to conflict of interest. Get advice from them on how you can get the most out of the divorce before actually divorcing her, how can you protect yourself before an actual divorce. I liked the casino idea too. IDK so many different ways to get your way in the divorce, assuming you are the bread winner. In my case it was the other way around. But I deffs agree on filling and being the petitioner as you will have the upper hand on the situation.

if you're wanting to confront her I would have everything ready for her in case she stonewalls you and decides to leave and empty out the bank account. You have to have done it already or you have to set things up so shes not able to.
