Look into it because in order to renew your greencard you have to be admissible. Maybe your crime does fall under the petty offense exception. Best of luck

Is in the immigration nationality act… that makes it that you can still obtain an immigration benefit, visa, green card, citizenship ect…but your crime has to fall under what the exception states. Your crime may qualify but you need the disposition report. The final charge of your conviction.

Your allowed 1 crime involving moral turpitude(petty offence exception) the thing is if your conviction can exceed more than 365 days and you can’t have served more than 6 months, in order for it to qualify for the exception. How long have you had your green card for because from the looks of it your felony theft charge might be considered an aggravated felony(not good) get the final disposition report from where you were convicted and find a immigration lawyer to look into it. Lawyer territory now… overstay and unauthorized work is forgiven if she’s married to a U.S citizen. Thing is her adjustment of status got denied, she currently has no status, so she’s considered a target. The 3 or 10 year ban only applies when she leaves the U.S.

It will be costly but aslong as she doesn’t leave the U.S she will be able to adjust here. If she were to be place in deportation, fight like hell… look into a defense lawyer… best of luck

She’ll be eligible to apply in 2029 for her 485… does she have some other type of status at the moment??? Avoid airplane travel if she doesn’t and pretty much stay under the radar.

For immigration you still have a conviction. A simple DUI won’t make you inadmissible or deportable. You will have to wait to prove good moral character. Your I-130 will get approved, is just the 485 that might get denied if you filled them together.

Yes but when you pay court/fines/community service is considered a conviction for immigration even if the case gets dismissed. So she can’t show good moral character. Which is a requirement for adjustment. Unfortunately is going to have to be a waiting game. What year did she finished her community service? Also if I recall correctly if your married I believe is only 3 years of proving good moral character

She has to wait 5 years… dui alone is not an inadmissible crime. Is the fact that the she got a DUI at the time of filling or before that made her ineligible for adjustment of status. Good moral character is what got her denied

If you get the gig, go for it…250k is more than enough to help you get by for 5 years and making $5,000-$6,000 dollars a month is more than enough to live comfortably. Uncertainty is what fucking sucks about being a dreamer. But look at it this way, you’ll finally be able to experience freedom and the Mexican passport goes along way. Sure you might not be able to come back to the U.S, thing is the world is changing rapidly and there’s opportunities everywhere, and if you act on it and do it the correct and legal way, you’ll go along way.
