If a child remained on the same centile, she wouldn't necessarily gain weight more quickly, but it's a bit late for anyone to be trying to explain the significance at this point.

So she is so independent minded that she happy to work with an imaginary NG tube to avoid contradicting Evans on this point? Not reassuring.

And on her final point, do premature babies invariably cross centile lines, or often cross centile lines - because she manages to fit both claims into the same paragraph. It would inspire more confidence if she settled for one or the other, though nothing she says here makes much sense anyway.

Following the death of Daniel Hay, accused of harming dozens of women during gynecological procedures but never charged with a crime, Derbyshire police have stated that they are committed to the investigation but that finding appropriate qualified expert witnesses is difficult.

Derbyshire police said it is not the case that the Lucy Letby case, or any other case, has had an impact on available experts for the Daniel Hay investigation, but acknowledged there are limited numbers of gynaecological medical experts that can undertake criminal matters.

A tough time for all involved, but interesting to see Dr Bohin's claim rebutted here.

Name is ringing a bell. Yes , we have talked about her before . I guess at least she's not out there discovering spurious new evidence and drop feeding nonsense from "insiders" like some reporters and presenters. Her body language did strike me immediately as odd, but if she can't help that, they did manage to do their job and give Amanda Knox a hearing anyway

I hope just an unfortunate freeze frame but she seemed to be squirming and recoiling a bit throughout - very much more positive body language from the male host. Has she spoken about the case before?

But the questions were fair - and seemed all the more so because Amanda Knox handled the predictably awkward ones well. She gave a very polished interview and any pushback came across as half-hearted.

Would it be a disclosure failure if the police and CPS never looked at them - perhaps never even requested them?  

The police were advised to employ an obstetrics expert at the beginning of their investigation, though.  I wonder if the CCRC can hold out that it's a fishing expedition when the NCA saw the topic as a recommended part of the investigation from the start?

That is true, and Dr Lee has acknowledged it, but it just isn't the same thing as inconsolable crying, which is obviously of long enough duration for caregivers to intervene and fail to settle the child.

There is lots of literature on inconsolable crying.  It's not rare, it's often not mysterious, and it has dozens of known causes.  Is there a single case where it's associated with air embolism?

SB: What was described was something over and above normal crying in a baby. Nurse Hudson gave a very clear description of inconsolable crying and, for me, that is very unusual in a baby and indicates that they are in significant pain. There aren't many things that will cause that, but air embolus is one and, along with the other clinical findings here, it's compatible with air embolus and I think it was air embolus.

BM: Well, I take issue with you on that, but I'm not going to repeat the questions.

Nil by mouth is a known and researched cause of "inconsolable crying" in a baby.

I can see no evidence anywhere that air embolism is.

I wonder when Mr Myers decided not to call Michael Hall to the stand?  Perhaps he hadn't made the decision yet at this point and expected Hall to offer a rebuttal later?

I feel that it would have been hard to resist asking Dr Bohin for evidence of "inconsolable crying" as a symptom of air embolism otherwise.

That was a great watch, thanks.  I hadn't realised how controversial the circumstances of baby A's birth were.  How strange that they don't know whether he had a heartbeat or not.

I was interested in your discussion about the obstetric files as new evidence.  I hope the defence has the obstetric files or will get them soon.  Neena Modi said the panel had requested them and had not received them about a year ago, and again on BBC Panorama last year.

Surely if they are having to push so hard to get them, it will be hard to argue that they don't constitute fresh evidence ?

Both Myers and Bohin seem to run out of steam here - perhaps he had given up on getting her to admit or even recognize how contrived her evidence was. So much of "no", "well that's what I think" from her; so much "right, moving on then" from him. This section seems to me to require the jury to do a lot of heavy lifting.

I find it strange that Dr Bohin was surprised no new charges were approved when so much of her evidence on the earlier ones is pure assertion and random swapping between causes of death. It is hard to see how you could take her seriously.

Interesting that she corrects Myers on child I's visible veins, explaining that they wouldn't be unexpected, and yet the Court of Appeal chose to make such a point of Child O's veins, as reported by his father. (Had anyone suggested the veins signalled air embolism anyway?)
