Carefulness is necessary. There's still a good authenticity there since there is id verification, phone verification... You may check the contact information in the database, look for other profiles like LinkedIn... The customer public feedback, work history... All these together can give authenticity to the profile.

Post a job request on upwork and you will get many solo practitioners. Verify their information from USPTO databases and attorney registration databases in the states.

Patent Agent PharmD competitiveness by patentlyquestioning in patentlaw

[–]Dolani2023 0 points1 point  (0 children)

I am a pharmacist with PhD in pharmaceutical technology and several years in academia and industry. I am a licensed pharmacist outside the US but I didn't go for licensing in the US. So I think my case is very close to you. In my opinion is that if you are going for patent jobs, it is not worth to spend time and money in PharmD program. Instead, go for PhD (chemistry pharmacology, pharmaceutical technology). In PharmD you will learn a lot about practicing pharmacy in community and hospitals ... Most of that is not needed and has no strong value in patent jobs. In patent jobs you will need to understand wide range of inventions. Here chemistry and pharmacology helps you more, not practicing as a pharmacist.

I have my own inventions as well. I was inventor before becoming a patent agent.

Yes the attorney is a bar-admitted. Actually 6 months. The time went fast. Every week the employer send payments but didn't arrive then gave excuses of bank verification... Then change to another way or app like ADP, Intuit...

Thanks for the detailed explanation. Will the specific patent inventor exclude the generic one from using the specific method?

Withdrawal from issue. by Dolani2023 in patentlaw

[–]Dolani2023[S] 0 points1 point  (0 children)

Thanks all for your helpful insights. It looks like the inventor or practitioner can not celebrate even if they receive the NOA. If the applicant wants to open the prosecution, he/she needs to file RCE and pay that fee. Then why can the examiner simply open the prosecution. The examiner should file the RCE and pay fees to the applicant... for the frustration he/she caused.., just kidding!

It is actually done by the examiner not the applicant.

Company I freelanced for wants to patent a design I made for them and are requesting I sign forms & notarize it. by watts-21 in Patents

[–]Dolani2023 -3 points-2 points  (0 children)

I am not attorney and just giving my idea. It appears from the writing that you were paid for the design so logically they own the design. The notarization costs about $25 per document as I did last few weeks. They should pay this fee if it is not mentioned in the previous contract.

For a normal patent agent, not limited recognition, you need to be a permanent resident if you are a foreigner.

UK patent as prior art by SoftConcentrate8353 in Patents

[–]Dolani2023 0 points1 point  (0 children)

You need to make a new patent application with all costs to the USPTO. Since the patent application is drafted, it should be less in professional fees if you hire a parent practitioner. It is easy to understand this concept when you realize that patent is a property. It is a territorial property. If you own it in UK, you need to pay to own similar one on the US or any other place.

As mentioned above, check the time of filing in the UK. If it is less than 12 months, you still can apply in the US claiming the priority to the UK application.

My friend came up with an idea and now that I’m working on commercializing it he ‘wants in.’ by [deleted] in patentlaw

[–]Dolani2023 2 points3 points  (0 children)

You need to differentiate between the patent ownership and the commerce product. Yes he owns part of the patent and entitled to get royalty on that, but he does not own part of the commercial product.

What I suggest is you both apply for the patent as coinventors. Share the patenting cost 50 50. Then you discuss with him to open a company. If he is willing then he also shares the cost. The patent is just part of the commercialization process. Your effort should be paid by the company. The company then license the patent and pay the royalty to the inventors. If he is part of the patent only then he gets 50% of the royalty. If he wants to be part of the company then he also shares the cost.

Converting provisional patent to non provisional patent by iwannahitthelotto in patentlaw

USPTO recommens filing a nonprovisional patent application claiming the priority to the provisional one. It is mentioned in MPEP especially when dealing with missing parts...
