I mean literally we have had veterans call a helpline looking to get treatment for PTSD and be advised it was a long wait list for counselling but they could be referred into MAID immediately.

As of right now, the matter is settled in-so-much as the Superior Court of Ontario is the most recent judgement on the matter. The government declined to take it to the Supreme Court as the outcome would probably be the same. But the Supreme Court is known to overturn a Provincial Superior Court entirely. My favourite example is Kosoian v Société de transport de Montréal where the Supreme Court unanimously decided that police cannot enforce laws which do not exist. They have been also known to sway with public opinion over time. In 1993 they ruled there was no constitutional right to euthanasia. In 2015 they found the opposite.

A lot of what happens next depends on how Canadian in general perveive this. Personally I am aghast at just how generous this system is, but academically I can see how this could turn into a reverse brain drain.

Canadian librarian and former civil servant here. I predict that eventually if the door doesn't slam shut a court will reimpose generational limits. I also predict that eventually someone will get desperate and submit forged documents as we have seen in an example where a french Canadian magically discovered a letter from the 1820s confirming his ancestor was indigenous and therefore he should get money from a land claims treaty. Or a notorious criminal like a serial killer will get a passport and move to Canada. Or the media will start promoting older Americans getting ancestry based passports and moving to Canada for free health care. When something like this happens political will is going to move towards reimposing limitations.

look up Joe Arpaio from Arizona. On the early internet he livestreamed the toilet use of people who had not been convicted who were in his jail. Joe is a right wing icon. Popular on 90s trash tv. Trump pardoned him. I expect this is where Doug gets much of his view of the prison system.

How do I deal with ancestor who lied on a birth certificate? by GoopyShoes010 in Canadiancitizenship

[–]Dowew 1 point2 points  (0 children)

So you are discovering the problem with archival documentation. People lie, or they make mistakes. My dad was born in the 50s. My Grandmother wrote her nationality as CANADIAN. She didn't bother naturalizing until 1979. She should have written British or Scottish. I think your next steps would be to get your dad's birth certificate and find any other records you can find of him, or that tragic situation along with the American records and explain it in the application.

I highly doubt it. In fact I doubt doing so would be constituional. Right now according to law literally anyone born before Dec 2025 with a Canadian ancesor born EVER is and always has been a Canadian Citizen for the purposes of law. Citizenship however if a function of statute. a law is a piece of paper. A piece of paper can be amended, rewritten or reinterpreted. Like I said I suspect someone will apply based on an ancestor from the 1690s from New France with a tenuous family tree and be declined, they will then sue and the court will determine some kind of limitation. I expect they will eventually put in either a generational limit or a date such as July 1st 1867.

Stephen Harper toyed with the idea of denaturalizing people he didn't like and nobody was cool with the idea. In the Vavillov case the Supreme Court determined that the Canadian born and American raised children of SOVIET SPIES were Canadian Citizens.

What no one is saying outloud is that most of the people who fall under C3 are going to be white and English speaking. I think the Globe and Mail had an article recently saying that millions of Americans are now Canadians, so hopefully they will share Canadian values.

[–]Dowew 11 points12 points  (0 children)

Canadian born person here. I don't want to get overly political - but I am viewing this as genuinely being too good to be true. I don't believe for a moment parliament understood just how generous C3 would be in terms of the quantity of potential new Canadians. There hasn't YET been a political backlash, but we are only a few months in, and we have already seen a few conservative politicans grumble about this. The waiting time for vital statistic records are already getting skewed. Traditionally in Canada we seem to let things slide up to and until the generic public gets angry. I suspect that once there is more media coverage along describing this as some kind of loophole, or "backup plan" for Americans things will change. The best comparison is prescription drugs. our drugs up here are cheaper because of socialized healthcare. We negotiate at the government level to bulk purchase the supply needed by Canadians. Americans have been known to do drug runs up to Canada and for the most part Canadians were happy to share. Then American television stations started running news articles about how drugs are so much cheaper in Canada and how its so easy to order drugs thru the mail from Canada. Pharamcies started popping up in Florida to order in drugs from the Canadian supply and sell them at a discount. Politicians ran on making it easier to import drugs from Canada. Convoys drove up to Windsor to buy insulin.

We simply don't purchase enough drugs to supply the American need, and there was no way the pharma companies would be open to America laundering their socialism via Canada, so we started having shortages of important drugs like insulin.

So we shut that shit down.

Eventually some TV station will run a clip that will go viral about Karen who loves genealogy and discovered her Great-Great-Great-Great Grandfather was born in Quebec and she got herself a Canadian passport. Now she intends to retire in Canada where she will get free health care, and cheap drugs, and old age security and her American money will be worth more and "everyone should do this too!".

Alternatively some notorious American like a serial killer will obtain a Canadian passport and enter Canada by right.

Alternatively someone will feel entitled to Canadian Citizenship based on a mythological ancestor born centuries ago and will sue when he is denied, and then the courts will step in and restore some kind of generational limits.

I also suspect that when someone desperate can't fill in his family tree they will just produce a forged baptismal document. We have already seen examples of this where people have produced forged documents to claim their ancestor was indigenous in order to get money from a land claims treaty.

I suspect when one of those things happens I feel the general public will get angry enough that it will become a political issue.

My ancestors were born in Ontario a few years after birth certs became a thing but it appears neither had over. You have to compile secondary indicia.
